Sec. 14.74. - Definitions.¶
Wherever the provisions incorporated refer to a county board, territory, area, agency, official, employee, or otherwise, it shall mean the corresponding Oceanside city board territory, area, agency, official, or employee, if such a city entity or individual exists; if no corresponding city entity or individual exists, the term shall refer to the county entity or individual active in that capacity on behalf of the city.

Sec. 14.75. - Disclosure, storage and disposal of medical waste.¶
Title 6, Division 8, Chapter 12 of the San Diego County Code of Regulatory Ordinances, Sections 68.1201 through 68.1211, are hereby adopted by reference by the city council of the City of Oceanside.

Sec. 14.76. - Permits and fees.¶
The fees for permits issued pursuant to this article shall be those established by the San Diego County Board of Supervisors for countywide application under the provisions of Section 68.1203(a) and (b) of the San Diego County Code of Regulatory Ordinances.

Sec. 14.77. - Violations.¶
(a) Criminal penalty. Violation of any of the provisions of this article shall be a misdemeanor punishable by imprisonment in the county jail not exceeding one year, or a fine not exceeding ten thousand dollars ($10,000.00), or both.
(b) Civil penalty. Any person who violates any of the provisions of this article shall be liable for a civil penalty not to exceed fifteen thousand dollars ($15,000.00) for each such violation.
(c) Additional remedies. The civil and criminal provisions of this article are remedies in addition to any existing remedy authorized by law and are not to be construed as conflicting with, or in dereliction of, any provisions of this article or of this City Code or of law. Said provisions are to be construed as independent and nonexclusive and in no way conditioned upon each other.

Sec. 14.78. - Enforcement.¶
The deputy director of the environmental health services division of the department of health services shall be responsible for enforcing the provisions of this article. The environmental health services division of the department of health services shall be the administering agency.

Sec. 14.79. - Severability.¶
If any section, sentence, clause or phrase of this article is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portion of this article. The city council hereby declares that it would have passed this ordinance and adopted this article and each section, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
