Sec. 14.20. - Purpose.

Because smoking tobacco, or any other weed or plant, is a positive danger to health and a cause of material annoyance, inconvenience, discomfort, and a health hazard to those who are present in confined spaces, and in order to serve public health, safety and welfare, the declared purpose of this article is to prohibit the smoking of tobacco, or any other weed or plant, in the Oceanside City Council Chamber.

Sec. 14.21. - Definition.

"Smoke" or "smoking," for the purposes of this article, shall include not only the action by a person involving the inhalation or partial inhalation of the smoke of a pipe, cigar, or cigarette, but shall also include the carrying of a lighted pipe, or lighted cigar, or lighted cigarette of any kind, and the lighting of a pipe, cigar or cigarette of any kind.

Sec. 14.22. - Posting of no smoking area.

The total area of the council chamber of the Oceanside City Council shall be clearly posted by the city manager with signs prohibiting smoking within the posted area during a public meeting.

Sec. 14.23. - Smoking prohibited.

No person shall smoke, as defined in section 14.21, in the area posted in accordance with section 14.22.

Sec. 14.24. - Violation and penalty.

Any person who continues to smoke in violation of section 14.23, after being advised of the prohibition of smoking, shall be guilty of an infraction and, upon conviction thereof, shall be punished in accordance with the fine schedule set forth in section 1.7 of this Code.
