§ 3-41. Fees for activities not specifically treated in article. [Ord. No. 436, § 48.]

Any activity not specifically covered in this article shall pay those fees established by negotiation between the operator and the city and they shall be determined by the type of undertaking, extent thereof, use of the field and services required and other factors applicable to the particular enterprise.

§ 3-42. Agreements, leases, etc., for the use of airport. [Ord. No. 436, § 49.]

The city council may enter into agreements with airlines, firms, individuals, corporations and partnerships to operate flying schools; to use the airport as a base for the carrying on of commercial activities; for the carrying for hire of passengers, freight, express or mail; for instruction in aviation in any of its branches; for private, noncommercial flying; for the sale of fuels, refreshments, aircraft, aircraft supplies or any commodity; and for other commercial purposes and may lease land at the airport and may lease buildings situated thereon.

§ 3-43. Payments to be made to director of finance. [Ord. No. 436, § 50; Ord. No. 1063, § 2.]

Any person having an agreement with the city providing for the payment of fees or charges to the city shall pay the fees or charges accruing thereunder to the director of finance.

§ 3-44. Refusal of clearance until all charges paid. [Ord. No. 436, § 35; Ord. No. 1068, § 1.]

The airport manager or the airport manager may refuse clearance to any aircraft until all charges for storage, supplies or services rendered to it shall have been paid.

ARTICLE V Airport Commission

§ 3-45. Established. [Ord. No. 436, § 1; Ord. No. 773, § 2.]

An airport commission is hereby established for the city.

§ 3-46. Membership. [Ord. No. 436, § 2; Ord. No. 656, § 1; Ord. No. 773, § 2; Ord. No. 787, § 1.]

The commission shall consist of five members, serving without pay, and two ex-officio members who shall be the city administrator and director of public works. The voting members need not be residents of the City of Oakdale.

§ 3-47. Term of office. [Ord. No. 436, § 3; Ord. No. 773, § 2.]

Members of the commission shall be appointed by the mayor with the consent of the city council for fouryear terms. A term of office for each commissioner shall expire on April 30 of the fourth year. Members of the commission shall have overlapping terms. Every two years, two members or three members respectively of the commission shall be appointed.

§ 3-48. Vacancies and removal. [Ord. No. 436, § 3; Ord. No. 773, § 2; Ord. No. 1033, § 2.]

Appointments to fill vacancies shall be for the remainder of the unexpired term. All members of the airport commission shall serve at and during the pleasure of the city council and may be removed with or without cause. A member who fails to attend at least seventy-five percent (three) of the annual meetings, without an excuse as approved by the commission chairman or the city administrator is presumed to be in nonperformance of duty and the city council may declare the position vacant and a new commissioner shall be appointed.

§ 3-49. Election of officers. [Ord. No. 436, § 4; Ord. No. 773, § 2.]

At its meeting after April 30 of each year, the commission shall elect a chairman and vice chairman to serve one year terms. These officers shall be elected annually.

§ 3-50. Secretary. [Ord. No. 436, § 4; Ord. No. 773, § 2.]

The commission shall select a secretary who need not be a member of the commission. The secretary shall keep minutes of each meeting and record the actions taken. When a roll call vote is taken, roll shall be taken with the chairman voting last. Minutes and recommendations shall expeditiously be forwarded to the city council.

§ 3-51. Meetings. [Ord. No. 436, § 4; Ord. No. 773, § 2.]

The commission shall hold a regular meeting quarterly. Special meetings may be called by the chairman or by three members of the commission by written notice served upon the members twenty-four hours before the proposed time of such meeting.

§ 3-52. Adoption of rules and records.[9] [Ord. No. 436, § 5; Ord. No. 773, § 2; Ord. No. 1068, § 1.]

The airport commission shall adopt rules for the transaction of business and shall keep a record of its resolutions, transactions, findings and determinations, which records shall be on file in the city clerk's office and shall be a public record.

§ 3-53. Quorum. [Ord. No. 773, § 2.]

Three members of the commission shall constitute a quorum.
