§ 18-46.010. Establishment of residential parking permit program. [Added 6-2-2025 by…

The City Council may by resolution establish preferential parking privileges on City-owned and leased land, streets, and off-street parking lots by enacting parking regulations restricting unlimited parking by non-residents in order to protect and enhance the quality of life of residential neighborhoods, while meeting the parking availability standards determined by the City to be appropriate for the area and providing the opportunity for residents to park near their homes.

§ 18-46.020. Definitions. [Added 6-2-2025 by Ord. No. 1291]

The terms used herein shall have the following meanings:

"Dwelling unit" — shall mean a self-contained house, apartment, stock cooperative unit, or condominium unit occupied by a single household exclusively for residential purposes.

"Eligible driver" — means a licensed driver identified as the registered owner of a currently registered vehicle who resides in a dwelling unit within a residential parking permit area.

"Guest permit" — means a temporary parking permit issued to a resident pursuant to this article or an ordinance enacted pursuant to the authority granted herein, for use by a person visiting a residence in a residential parking permit area or for workers providing services such as caregiving, gardening, repair maintenance and construction to the resident, which shall exempt the guest's vehicle from parking time restrictions established pursuant to this article.

"Non-resident vehicle" — means a motor vehicle operated by a person whose destination is not to a residence within a residential parking permit area or otherwise not eligible to be issued a residential parking permit, pursuant to the terms and conditions of this article, for the specific area in which it is parked.

"Resident" — shall mean a natural person living in a dwelling unit in a residential parking permit area.

"Residential parking permit area" — means any contiguous area upon which the City Council imposes parking limitations pursuant to the authority granted by this article.

§ 18-46.030. Designation criteria for residential parking permit program. [Added…

Designation of residential parking permit areas will be limited to areas with a recommended minimum street-frontage of approximately 2,000 feet that experience impacts from external parking demand which include factors such as commercial areas, recreational areas, schools and neighboring cities. There shall be two alternative processes by which the City Council can consider any such area for designation as a residential parking permit area:

  • (a) Initiation by residents: The City Council shall consider for designation as a residential parking permit area any such proposed area for which a petition has been submitted that meets and satisfies the following requirements and any administrative guidelines adopted by the City Council:

    • (1) A petition signed by a majority (60% or greater) of dwelling units is required to initiate the process for consideration for designation as a residential parking permit area.

    • (2) Only one signature per dwelling unit will be considered for a petition.

      • a. For petitions involving rental complexes, the residents and property owners will participate in the petition survey.

      • b. If the units in a multifamily property are individually owned, each owner would be included in the petitioning process.

  • (b) Initiation by City Council or City Manager: The City Council or City Manager shall initiate the process for consideration for designation as a residential parking permit area a location that satisfies the following requirements and any administrative guidelines adopted by the City Council:

    • (1) That non-resident vehicles do, or may, substantially interfere with the use of on-street or alley parking spaces by neighborhood residents;

    • (2) That the interference by the non-resident vehicles occurs at regular and frequent intervals, either daily or weekly;

    • (3) That the non-resident vehicles parked in the area of the proposed residential parking permit area create traffic congestion, noise, or other disruption (including shortage of parking spaces for residents and their visitors) that negatively impacts the quality of life of the neighborhood;

    • (4) Other alternative parking management strategies are not feasible or practical.

  • (c) Upon receipt of a valid resident's (majority) petition for a residential parking permit area or upon City Council or City Manager's initiation as described above, the Public Works Director shall do the following:

    • (1) Conduct or cause to be conducted a parking occupancy survey to determine the utilization of on-street parking, by which an 85% parking occupancy threshold of all available on-street parking and visible off-street parking is required for further consideration;

    • (2) Issue a notice of intent to establish residential parking permit restrictions to all dwelling units within the proposed residential parking permit area;

  • (3) Refer the matter to the City's Planning Commission for review; and

    • (4) Present to the City Council for final action a resolution that would establish a residential parking permit area in accordance with requirements of this article, including all regulations and time restrictions determined by the City Council to be reasonable and necessary for such area.

      • a. Once City Council has taken final action on such a resolution to establish a residential parking permit area, no further changes or requests for changes in resident permit parking restrictions for this area will be considered for a minimum period of one year.
  • (d) The City Manager may restrict all or certain portions of City-owned property other than streets, alleys or highways as residential parking permit only; when authorized signs have been posted giving notice of such residential parking permit restrictions. It is unlawful and an infraction for any person to park or leave standing a vehicle within such area during the times and days when such parking is prohibited, other than a vehicle that has been issued a valid residential parking permit or exempted pursuant to the provisions of this article.

  • (e) The City Council may, by resolution, modify a designated residential parking permit area in any manner consistent with this article.

§ 18-46.040. Parking permit exemption. [Added 6-2-2025 by Ord. No. 1291]

  • (a) A motor vehicle that has been assigned a valid residential parking permit as provided for herein shall be permitted to stand or be parked in the residential parking permit area for which the permit has been issued without being limited by time restrictions established pursuant to this article or any resolution hereunder. Any vehicle that has not been issued a valid parking permit shall be subject to the residential parking permit regulation and consequent penalties in effect for such area.

  • (b) A residential parking permit or any other permit as designated by the City Council shall not guarantee or reserve to the holder thereof any parking space within the residential parking permit area for which the permit was issued.

  • (c) Residential parking permit restrictions shall not apply to police vehicles, authorized emergency vehicles, or City-owned vehicles when used for official business.

  • (d) Nothing in this article, nor any permit issued pursuant thereto, shall authorize a violation of Section 18-9 of this chapter.

  • (e) This article shall not be interpreted or applied in a manner that shall abridge or alter regulations established by authority other than this article.

§ 18-46.050. Issuance and duration of permits. [Added 6-2-2025 by Ord. No. 1291]

  • (a) Residential parking permits shall be issued by the City's Finance Department in accordance with the requirements set forth in this article and shall be valid only in the residential parking permit area for which it is issued.

  • (b) Residential parking permits shall be issued with a term not to exceed one year, unless earlier revoked or terminated, provided, however, that a permit shall automatically terminate when the permit holder ceases to reside in the designated residential parking permit zone.

  • (c) No residential parking permit issued pursuant to this article shall be transferable from the permit holder to any other person, nor from one vehicle to another.

§ 18-46.060. Residential parking permits. [Added 6-2-2025 by Ord. No. 1291]

  • (a) A residential parking permit may be issued only to an eligible driver who can demonstrate that they currently reside at an eligible dwelling unit within the residential parking permit area for which the permit is to be issued.

  • (b) To be issued a residential parking permit, each eligible driver shall provide the following information:

    • (1) The applicant's full, true name and home address, and proof of residence;

    • (2) The applicant's driver license;

    • (3) A valid and current vehicle registration and license plate number of the vehicle for which a permit is being requested;

    • (4) Such other information as required by the City Manager or their designee.

  • (c) A temporary residential parking permit shall be issued to an eligible driver for a rented or borrowed registered vehicle where the eligible driver, residing in a residential permit parking zone, demonstrates their own vehicle is unavailable for that driver's use for a temporary period. Such permits will expire upon the return to use of the originally permitted vehicle or its replacement.

  • (d) The City Council may, by resolution, limit the number of permits issued to any resident, dwelling unit, or residential parking permit area if such limitation would further the goals of the residential parking permit program.

  • (e) Residential parking permits will not be issued to non-motorized vehicles (i.e., trailers) or to commercial vehicles that are registered at business addresses. For the purposes of this article, a "commercial vehicle" shall have the same meaning as that term is defined in Section 260 of the California Vehicle Code.

§ 18-46.070. Guest parking permits. [Added 6-2-2025 by Ord. No. 1291]

  • (a) The City Council may, by resolution, authorize the issuance of temporary guest parking permits in any residential parking permit area. When authorized, a resident within a residential parking permit area may apply for temporary parking permits for use by their guests in the residential parking permit area where the resident resides.

  • (b) Guest permits may be issued under the following conditions:

    • (1) The resident applicant for a guest parking permit has not reached the limits, if any, set by the City Council.

    • (2) Such other conditions and restrictions that the City Council by resolution imposes or that the City Manager, or designee, deems appropriate.

  • (c) Use of guest parking permits shall comply with residential parking permit regulations established pursuant to this article to be valid within the residential parking permit area for which it was assigned.

    • (1) Intentional or repeated misuse of guest parking permits by a resident or their guests may be cause for revocation of the resident's guest parking permit privileges.
  • (d) A guest parking permit shall be valid for a prescribed period of time, commencing upon the date authorized, and shall exempt the applicable vehicle from parking time restrictions established

pursuant to this article.

§ 18-46.080. Residential parking permit areas – Designation. [Added 6-2-2025 by Ord.…

Upon adoption by the City Council of a resolution designating a residential parking permit area, street parking in the area shall be limited for a period as determined by the Public Works Director; provided, however, that unlimited parking shall be allowed by vehicles for which a residential or guest parking permit has been obtained in accordance with requirements of this article or unless otherwise designated.

§ 18-46.090. Residential parking permit areas – Posting. [Added 6-2-2025 by Ord. No. 1291]

Upon adoption by the City Council of a resolution designating a residential parking permit area and after at least 75% of the households have purchased permits, the Public Works Director shall cause appropriate signs to be erected in the area, indicating prominently thereon the area prohibition or time limitation, period of its application, and conditions under which permit parking shall be exempt therefrom.

§ 18-46.100. Residential and guest parking permit fees. [Added 6-2-2025 by Ord. No. 1291]

The fees for residential parking permits and for guest parking permits shall be established by City Council resolution.

§ 18-46.110. Penalties and enforcement. [Added 6-2-2025 by Ord. No. 1291]

The following acts shall constitute fraudulent use of a permit punishable by a fine to be prescribed by City Council resolution and/or revocation of any permit currently held. Violations of this article shall include the following:

  • (a) Falsely representing oneself as eligible for a residential parking permit or furnishing false information in an application therefor.

  • (b) Using a residential parking permit issued pursuant to this article for any motor vehicle other than that for which the permit was issued.

  • (c) Copying, reproducing, or otherwise bringing into existence a counterfeit residential parking permit or permits without written authorization from the Finance Director or their designee.

  • (d) Knowingly using or displaying a facsimile or counterfeit parking permit in order to evade time limitations on parking applicable in a residential permit parking area.

  • (e) Selling, transferring, or exchanging a residential parking permit or permits with any other person except as provided for in this article and without written authorization from the Finance Director or their designee.

  • (f) Knowingly committing any act that is prohibited by the terms of this article or any ordinance or resolution enacted by authority granted by this article.

  • (a) A residential parking permit area may be revoked by resolution of the City Council after following the same procedures for establishing a residential parking permit area as set forth herein.

  • (b) If 75% of the households in a residential parking permit area fail to purchase permits after being duly noticed, the City Manager may revoke the residential parking permit area upon notice to the residents

without further action of the City Council.

§ 18-46.130. Residential parking permit policy. [Added 6-2-2025 by Ord. No. 1291]

The City Council, the City Manager and/or their designee may adopt policies and/or administrative regulations to implement this article, including, but not limited to, the establishment of a residential parking permit area and the criteria for the issuance, denial, revocation, duration and/or number of permits per household, consistent with the authority granted by this article.
