§ 18-1. Uniform Traffic Ordinance – Adopted.

All of the provisions of the Uniform Traffic Ordinance, 1964 Edition, adopted by the League of California Cities, are adopted and made a part of this chapter as though fully set forth herein.

§ 18-2. Uniform Traffic Ordinance – Amendments.

(a) Section 2.5 of the Uniform Traffic Ordinance is amended to read as follows:

"Section 2.5. Director of public works. The office of director of public works is hereby established. The director of public works shall be appointed by the city administrator as appointing authority, and he shall exercise the power and duties as provided in this ordinance and in the traffic ordinances of the city. Whenever the director of public works is required or authorized to place or maintain official traffic-control devices or signals, he may cause such devices or signals to be placed or maintained."

(b) Section 2.7 of the Uniform Traffic Ordinance is amended to read as follows:

"Section 2.7. Traffic commission. There is hereby established an advisory traffic commission to serve without compensation, consisting of three members appointed by the mayor and approved by the city council, none of which may be city employees. They shall be removed by a majority vote of the city council. The chairman of the commission shall be appointed by the mayor and may be removed by him. The commission shall meet at the call of the chairman or by written request of the director of public works."

(c) Subsection (a) of Section 3.8 of the Uniform Traffic Ordinance is amended to read as follows:

"Section 3.8(a). Any vehicle that has been parked or left standing upon a street or highway for one hundred twenty or more consecutive hours."

(d) There is adopted a section to be numbered 8.9, which section is to be a part of the Uniform Traffic Ordinance adopted by this chapter, such section to read as follows:

"Section 8.9. Yield intersections. Whenever any ordinance or resolution of this city designates and describes any intersection of streets as a yield intersection, the director of public works shall erect and maintain yield right-of-way signs at not more than two entrances to such intersections, such signs to be located on the same street."

(e) Section 7 of the Uniform Traffic Ordinance is amended to read as follows:

"Section 7. The director of public works to erect stop signs. Whenever any ordinance or resolution of this city designates and describes any street or portion thereof as a through street, or any intersection at which vehicles are required to stop at one or more entrances thereto, or any railroad grade crossing at which vehicles are required to stop, the city traffic engineer shall erect and maintain stop signs as follows:

A stop sign may be erected on each and every street intersecting such through street or portion thereof so designated and at those entrances to other intersections where a stop is required and at any railroad grade crossing so designated; provided, however, stop signs shall not be erected or maintained at any entrance to an intersection when such entrance is controlled by an official traffic control signal. Every such sign shall conform with, and shall be placed as provided in, the Vehicle Code."

(f) Section 217 of the Uniform Traffic Ordinance of the city is hereby repealed.

(g) Section 10-4 of the Uniform Traffic Ordinance is repealed.

(h)

(1) No person shall stop, stand or park, or permit to be stopped, left standing or parked, any commercially registered bus, semi-truck, trailer, tractor, or motor truck having a manufacturer's gross vehicles weight rating of ten thousand (10,000) pounds or more on any street except on any street designed as a truck route for a period of time longer than thirty (30) minutes between the hours of 2:00 a.m. and 6:00 a.m.

(2) Commercial vehicles having a manufacturer's gross vehicle weight rating of ten thousand (10,000) pounds or more are prohibited from parking or standing on any street in any residential district unless the commercial vehicle is making pickups or deliveries of goods, wares, and merchandise from or to any building or structure located in a residential district or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure located in a residential district for which a building permit has previously been obtained.

(3) When any such truck route or routes are established and designated by appropriate signs, the operator of any commercial vehicle or any vehicle exceeding a maximum gross weight of three (3) tons shall drive on such route or routes and no other, except when necessary to traverse another street or streets to a destination for the purpose of loading or unloading but then only by such deviation from the nearest truck route as is reasonably necessary.

(4) The provisions of this section shall not apply to:

a. Passenger buses under the jurisdiction of the Public Utilities Commission;

b. Any vehicle owned by Public Utility while necessarily in the use in the construction, installation, or repair of any public utility; or

c. Refuse collection vehicles that operate on City streets pursuant to the provisions of a valid franchise agreement.

§ 18-3. Parking Aides.

(a) The Chief of Police is hereby authorized to designate regularly employed and salaried employees of the Police Department as parking aides.

(b) Parking aides shall enforce the provisions relating to regulation of traffic and to stopping, standing and parking of vehicles contained in Chapter 18 of the Oakdale Municipal Code, the Uniform Traffic Ordinance, 1964 Edition, and in the Vehicle Code of the State of California.

(c) Civilian employees of the City of Oakdale or independent contractors designated by the Chief of Police may enforce provisions of this chapter and the California Vehicle Code relating to the standing or parking of vehicles that legally may be enforced by persons other than peace officers.

§ 18-4. Central Traffic District.

(a) The Central Traffic District is defined as all streets and portions of streets within the area described as follows: All that area bounded by and including First Avenue, between D Street and G Street; D Street, between First Avenue and Yosemite Avenue; Yosemite Avenue, between D Street and E Street; E Street, between Yosemite Avenue and Fourth Avenue; Fourth Avenue, between E Street and G Street; and G Street, between Fourth Avenue and First Avenue. The foregoing shall be construed to include the intersections of the bounding streets.

(b) The Public Works Director may designate time-limited and short-term parking zones within the Central Traffic District. Unless otherwise permitted by signs, no person shall stop, stand or park a vehicle in a time-limited or short-term parking zone between the designated hours on any day for longer than the prescribed period, when authorized signs are in place giving notice thereof. For purposes of this section, the terms "time-limited parking zone" and "short-term parking zone" mean an area in which signs or curb markings prescribe a specified period for parking of vehicles.

(c) Any vehicle that has not moved a distance of 150 feet in the Central Traffic District preceding the prescribed parking time limit for the space in which the vehicle was parked or left standing shall be deemed to have remained stationary.

§ 18-5. Parking restrictions and markings.

(a) The City Council may, by resolution, prohibit or restrict the parking or standing of vehicles on certain streets or portions thereof during all or certain hours of the day, or for periods in excess of certain stated time limits, or may designate certain streets or portions thereof upon which preferential parking privileges shall be given to residents and/or merchants adjacent to such streets under which such residents and/or merchants may be issued a permit which exempts them from the prohibition or restriction of such resolutions. It is unlawful to disobey any such prohibitions or restrictions.

(b) The Public Works Director may cause parking spaces on streets or off-street parking lots to be marked with white lines designating such parking spaces. No person shall stop, park, or leave standing any vehicle on a street or off-street parking lot in any manner other than wholly within a parking space so designated.

§ 18-6. Parking on private property of another person.

No person shall park a vehicle in a private driveway or on private property without the direct or implied consent of the owner or person in lawful possession of such driveway or property.

§ 18-9. Use of streets for storage of vehicles prohibited.

(a) No person who owns or has possession or control of any vehicle that is principally designed or used for hauling livestock, including, but not limited to, horses, cattle, sheep, goats and poultry, shall park such vehicle upon any street or alley for a period longer than 48 consecutive hours.

(b) No person who owns or has possession of any vehicle, other than the vehicles described in Subsection (a) of this section, shall park such vehicle upon any street or alley for a period longer than 72 consecutive hours.

(1) Any vehicle parked or left standing upon any street or alley in the Central Traffic District that has not moved a minimum distance of 150 feet after 72 consecutive hours shall be deemed to have remained stationary.

(c) In the event a vehicle is parked or left standing upon a street or alley in excess of the time limits specified in Subsections (a) and (b) of this section, any member of the Police Department authorized by the Chief of Police may remove the vehicle in the manner and subject to the requirements of the Vehicle Code of this state.

§ 18-10. Standing in parkways and parks prohibited.

(a) No person shall stop, stand or park a vehicle within any parkway.

(b) No person shall stop, stand or park a vehicle on any City park or recreation area, save and except in areas designated for stopping, standing or parking at any City park.

§ 18-12. Crossing roadways at right angles.

No pedestrian shall cross a roadway at any place other than by a route at right angles to the curb or by the shortest route to the opposite curb, except in a marked crosswalk.
