To prevent health hazards which would otherwise result.

To provide for the orderly and efficient development of the City of Novato.

5-37.008 Standards.

a.

General. All affected projects shall provide for sewage disposal in a sanitary manner which provides for the public health and safety.

b.

Specific.

1.

All developments and use proposals shall include provisions for connection to the public sewage facilities of the Novato sanitary district or other publicly-owned sewage facilities.

2.

Where a development or use proposal involves an existing private sewage disposal system, such system shall be discontinued and a connection to publicly-owned facilities shall be made.

3.

Any request for exception to paragraphs 1 or 2 above, which asks use of a private sewage disposal system, shall include:

(a)

A written statement from the applicant setting forth the minimum requirements for connection with the publicly-owned facilities and giving facts or reasons why such connection should not be required. This statement shall be corroborated by the public sewage agency.

(b)

Written technical information which justifies a private sewage disposal system and indicates that the system will function successfully from the standpoint of the future owner/operator and from the standpoint of community health.

4.

Specific regulations governing engineering requirements, percolation tests, septic tanks, drain fields, and related facilities shall be as adopted by the city council.

c.

Approvals. The city engineer shall receive and interpret information submitted in conformance with this section.

The city engineer shall recommend whether or not new or additional lots or structures should be created and/or modifications made in numbers of lots or units, lot design and sewage disposal system requirements. Such recommendations shall be a basis for approvals of land divisions, subdivisions or structures where use of private sewage disposal systems are proposed.

2.

In the case of a single family structure proposed on a legal lot existing on the effective date of this ordinance, the city engineer shall approve, conditionally approve, or deny the request for an individual sewage disposal system provided that an exception to paragraph b.1 and/or b.2 above has been granted. Denial shall be only on the basis of noncompliance with the specific regulations mentioned in paragraph b.4 above.

5-41.006 Purpose. To insure that uses and/or developments recognize the need to provide for the storage of solid waste and to recognize that the location and type of storage has a bearing upon the capacity for and cost of collection.

5-41.008 Standards.

a.

General. Novato Disposal Service Inc., operating under rules and regulations established by ordinance of the Novato Sanitary District, has the franchise for and the responsibility for the collection of solid waste within the city.

b.

Specific.

1.

In all developments, solid waste collection points shall be provided within 75 feet of a through or cul-de-sac street.

2.

Where provision 1, above, results in a common collection point accommodating three or more units, a screened platform or paved area, of sufficient size to accommodate a 35-gallon size container for each unit, shall be provided.

3.

Where a bin-type container is to be used to store solid waste for collection, the location of that bin and the access thereto shall allow adequate maneuvering room for a truck eight feet in width, 26½ feet in length, an inside turning radius of 25 feet and an outside turning radius of 36 feet.

4.

Where bin-type containers are to be used to store solid waste for residential developments such bins shall be provided on the basis of one 3-yard bin for each eight dwelling units.

5.

Each application for permit or approval which involves solid waste collection shall be accompanied by a letter from the Novato Disposal Company stating that they have reviewed the proposed development or use and setting forth their comments on the design for provision of solid waste storage.
