Chapter 2.18 — HOUSING AND BUILDING LOCAL APPEALS BOARD

§ 2.18.010. Created.

A Housing and Building Local Appeals Board ("Board") is hereby created and established. The Planning Commission is hereby designated as the Board. In the event the entire five-member Board has not been appointed, the City Council shall act as the Housing and Building Local Appeals Board.

§ 2.18.020. Definition, powers and duties.

  • A. The Board shall have the same meaning as the "Local Appeals Board" and "Housing Appeals Board" as set forth in Health and Safety Code Sections17920.5 and 17920.6 respectively and, California Building Code Section 1.8.8.2.

  • B. The Planning Commission, sitting as the Board is authorized to: (1) hear appeals as defined and set forth in Sections 1.8.8.2 and 1.8.8.3 of the California Building Code; and (2) conduct administrative hearings for those responsible persons contesting administrative citations pertaining to violations related to housing, building, plumbing, electrical or other similar structural issues, including when the subject matter of a decision, order or determination relates to building requirements, or the use, maintenance and change of occupancy of buildings and structures, including requirements governing alteration, additions, repair, demolition and moving.

  • C. The Board shall serve without compensation. (Ord. 21-1725 § 1)

§ 2.18.030. Meetings.

The Board shall hold a meeting at least once each fiscal year. The Board shall hold additional special meetings as are required in order to conduct business of the Board as required by the Norwalk Municipal Code. Board meetings are open to the public and shall be noticed in accordance with law. Three members of the Board shall constitute a quorum for the transaction of the business.

§ 2.18.040. Rules and proceedings.

  • A. Except as otherwise provided in this chapter or by law, the Board shall have the power to and shall provide for its own organization; shall adopt rules and regulations for the transaction of business before it; and shall designate the time and place for its yearly meeting and any other meetings of the Board.

  • B. The Board shall keep a public record of its resolutions, transactions, findings and determinations.

§ 2.18.050. Attendance.

  • A. Participation in the regular and special meetings of the Board is essential to the

  • performance of its duties. Accordingly, any member who shall fail to attend three consecutive regular or special meetings, unless otherwise determined by action of the City Council, shall be removed and replaced by the Mayor, with the approval of the City Council, or by a majority vote of the City Council.

  • B. It shall be the duty of the Secretary of the Board to keep a public record of the attendance of Board members; and to promptly advise the City Council in the event any vacancy shall exist, or in the event any member of the Board shall be absent for three successive regular or special meetings.
