1.20.010 - Arrests by public officers and employees without warrant.

A public officer or employee, when authorized by ordinance, may arrest a person without a warrant whenever he/she has reasonable cause to believe that the person to be arrested has committed a misdemeanor in his/her presence which is a violation of an ordinance of the city which such officer or employee has the duty to enforce.

1.20.020 - Notice to appear.

In any case in which a person is arrested pursuant to Section 1.20.010 and the person arrested does not demand to be taken before a magistrate, the public officer or employee making the arrest shall prepare a written notice to appear and release the person on his/her promise to appear, as prescribed by Chapter 5C, Title 3 Part 2 (commencing with Section 853.6) of the California Penal Code. The provisions of said chapter shall thereafter apply with reference to any proceeding based upon the issuance of a written notice to appear pursuant to this section.

1.20.030 - Application.

The provisions of this chapter shall apply to any section or sections of any ordinance of the city, violations of which are punishable as misdemeanors.
