8.42.010 - Authority.

The board of supervisors exercises the option provided for in Chapter 7 (commencing with Section 5551) of Part 1 of Division 4 of the California Food and Agricultural Code (hereafter referred to as "Chapter 7") to set time limits for the abatement process required by that chapter in order to provide for the public health, safety, and general welfare of the residents of Napa County.

8.42.020 - Time limits for the abatement process.

The record owner, or person in possession, or person in charge of any property in the county having neglected and/or abandoned plants or crops thereon which are determined by the agricultural commissioner to constitute a public nuisance shall abate such nuisance upon being advised of such determination and order. The order to abate shall be complied with within three days after the date the order was personally served, five days if service is by mail, or by such date agreeable to the agricultural commissioner. If said order is not complied with, the agricultural commissioner shall report the existence of the nuisance to the county counsel with a request that a legal action be filed praying for an order to remove or destroy the neglected and/or abandoned plants or crops as provided for in Chapter 7.

8.42.030 - County Counsel authority.

The county counsel is authorized to file the petition to remove or destroy neglected and/or abandoned plants or crops, and bring an action to foreclose on any abatement lien, as provided for under Chapter 7.

8.42.040 - Remedies not exclusive.

Remedies under this chapter and Chapter 7 are in addition to and do not supersede or limit any and all other remedies, civil or criminal.
