17.44.010 - Standards for setting monuments.

The requirements for setting monuments involving parcel maps and final maps are set forth in the Napa County Road and Street Standards and shall be complied with.

17.44.020 - Survey monuments—Work by engineer or surveyor.

A. At the time of making the survey for the final map or parcel map, the engineer or surveyor shall set sufficient durable monuments to conform with the standards described in Section 8771 of the Business and Professions Code, so that another engineer or surveyor may readily retrace the survey, all in accordance with the requirements of this chapter. At least one exterior boundary line of the land being subdivided shall be adequately monumented or referenced before the map is recorded.

B. Interior monuments need not be set at the time the map is recorded, if the engineer or surveyor certifies on the map that the monuments will be set on or before a specified later date, and if the subdivider furnishes to the board security guaranteeing the payment of the cost of setting such monuments.

17.44.030 - Completion of work—Compensation and security.

A. Within five days after the final setting of all monuments has been completed, the engineer or surveyor shall give written notice to the subdivider and to the county surveyor that the final monuments have been set. Upon payment to the engineer or surveyor for setting the final monuments, the subdivider shall present to the board evidence of the payment and receipt thereof by the engineer or surveyor.

B. In the case of a cash deposit, the board shall pay the engineer or surveyor for the setting of the final monuments from the cash deposit, if so requested by the depositor.

C. If the subdivider does not present evidence to the county surveyor that the engineer or surveyor has been paid for the setting of the final monuments, and if the engineer or surveyor notifies the board that payment has not been received from the subdivider for the setting of the final monuments, the board shall, within three months from the date of such notification, pay the engineer or surveyor, from any deposit, the amount due.

17.44.040 - Effect of death or disability of engineer or surveyor.

In the event of the death, disability or retirement from practice of the engineer or surveyor charged with the responsibility for setting monuments, or in the event of his refusal to set such monuments, the board may direct the county surveyor or such engineer or surveyor as it may select to set such monuments. If the original engineer or surveyor is replaced by another, the former may, by letter to the county surveyor, release his obligation to set the final monuments to the surveyor or engineer who replaced him. When the monuments are so set, the substitute engineer or surveyor shall amend any map filed pursuant to this chapter in the manner set forth in Chapter 17.26 of this title. All provisions of this chapter relating to payment shall apply to the services performed by the substituted engineer or surveyor.
