1.16.120 - Authority.

This article is adopted pursuant to Article 14 Section 5 of the California Constitution as added by Initiative Measure Proposition 139.

1.16.130 - Inmate vocational training programs.

Inmates of the Napa County department of corrections shall be eligible to participate in vocational training programs as determined by current classification policies of the department, Title 15 of the California Code of Regulations as it pertains to minimum jail standards, rules and regulations implemented by the director, and other applicable laws, rules, and regulations. The purpose of all such programs shall be to give participating inmates at least some minimum job skill training.

1.16.140 - Rules and regulations.

The director of the department of corrections shall prepare and implement the rules and regulations under which inmates shall participate in vocational training programs.

1.16.150 - Supervision.

All inmates who participate in vocational training programs shall be supervised by staff of the department of corrections, other county departments, or other agencies which contract with the county pursuant to this article.

1.16.160 - Compensation.

The county shall not pay inmates who participate in vocational training programs, and no such inmate shall earn or be entitled to earn additional good time or work time credits or any other special consideration.

1.16.170 - Status as employee.

A. No inmate who participates in a vocational training program shall be, or shall be considered, an employee of the county for purposes of workers compensation or any other purpose.

B. The labor performed by an inmate pursuant to this article shall be deemed compelled pursuant to Article 1 of Chapter 1.16.

1.16.180 - Certificate of participation.

The county shall give each inmate who satisfactorily participates in a vocational training program a written certificate of participation which attests to his or her participation in the program and which generally describes the training given and the number of hours the inmate participated.

1.16.190 - No guarantee of work.

Nothing in this article guarantees, or shall be construed as guaranteeing, that an inmate has the right to work or to participate in a vocational training program or any other program conducted by the county.
