SEC. 35.26. - General water service rates—Inside schedule.

(a) Applicability. General water service rates shall be applicable to all domestic, commercial, industrial and general uses.

Territory. Within the incorporated limits of the City of Mountain View, except as hereinafter provided in subsection b.

Rates shall be in amounts fixed by resolution or ordinance of the city council.

(b) Applicability. General water service rates shall be applicable to all domestic, commercial, industrial, and general uses.

Territory. Those properties inside the incorporated limits of the City of Mountain View previously served by the North Los Altos Water Company, which became a part of the city water system, through purchase from the City of Los Altos pursuant to an agreement with Los Altos dated March 8, 1977, and which have not acquired full rights of service and use.

Rates shall be in amounts fixed by resolution or ordinance of the city council.

SEC. 35.27.1. - Adjustments of water bills.

The public services director or designee shall be authorized to adjust a customer's water bill based on the following guidelines set forth in this section and for unforeseen or unusual circumstances on a case-by-case basis:

a. Water use required due to a medical necessity certified by a medical doctor that falls into the third tier shall be adjusted to the second-tier rate as specified in the city's rate resolution. The doctor's certification shall include the following information: (1) verification and description of the medical condition, (2) the length of time the condition will exist, and (3) the number of times a week the customer must use the additional water. To receive adjustment, the customer must make a written request for a water bill adjustment to the public services director and include documentation about the amount of water to be used and the doctor's certification.

b. If an underground pipe leak is repaired within one (1) billing period of first becoming apparent on the customer's bill, the customer shall pay for the cost of all water use at the first- and second-tier rate, as appropriate and specified in the rate resolution. To receive the adjustment, the customer must make a written request to the public services director and provide evidence satisfactory to the public services director in the form of a repair bill for parts and services that the leak has been repaired. The customer's bill must reflect a return to a normal use level in the next billing period before an adjustment may be granted. Water use that falls into the third tier that is greater than the average "normal" use in the same billing period in the previous year shall be adjusted to the second-tier rate. This type of adjustment may only be granted once in a three (3) year period to a customer.

c. Customer shall not be charged for water loss as a result of an act or omission on the part of the city.

d. Water loss as the result of a natural disaster, such as a freeze or an earthquake, shall be adjusted to the first- and second-tier rate as specified in the rate resolution.

The decision of the public services director or designee shall be final.

This section shall apply to water bills charged by the city pursuant to Sec. 35.26, 35.27 or 35.28.

SEC. 35.28. - Special water service rates.

Special water service rates shall be established for building and construction uses and for nonpotable water uses. The rates shall be in amounts fixed by resolution or ordinance of the city council.
