SEC. 26.11. - Permit to operate—Required.¶
No person shall engage in the business of maintaining or operating any public poolroom or billiard rooms in the city without first obtaining a permit to do so issued by the chief of police.

SEC. 26.11.1. - Definitions.¶
Pool or billiard table. Pool or billiard table shall mean any table regardless of size upon which games of pool or billiards, or any other games involving balls and cues, are played.
Pool or billiard room. Pool or billiard room shall mean any room in which there are one (1) or more pool or billiard tables and a fee or anything of value is assessed for the privilege of using the tables, whether the said fee is paid directly to a designated person or is inserted into a slot or receptacle attached to the said tables.

SEC. 26.12. - Permit—Duration; transferability.¶
The permit shall be issued for an indefinite period except as otherwise provided in this article. No permit issued under the provisions of this article shall be transferable by operation of law or otherwise without the prior written consent of the chief of police; and any purported transfer of the permit shall render the permit void.

SEC. 26.13. - Same—Application; fee.¶
An application for a permit shall be filed with the chief of police and shall contain such information as shall be deemed necessary by the chief of police. The application shall be accompanied by a permit fee in an amount established by council resolution.

SEC. 26.14. - Same—Prerequisites to issuance.¶
The chief of police shall issue a permit only after he has reviewed the application and determined that the contents of the application are true, that the applicant is a fit and proper person to carry on such business and that the applicant has complied with the provisions of this Code, other ordinances of the city and the laws of the state. Every person engaged in the business of maintaining or operating any public poolroom or billiard room must apply for and obtain a permit within thirty (30) days after the effective date of this article.

SEC. 26.15. - Minors—Operator prohibited from allowing where alcohol permitted if…¶
No person owning, leasing or operating any public pool or billiard room, and no agent, employees, representative or concessionaire of such person, shall permit any minor under the age of eighteen (18) years to enter or remain in any such public pool or billiard room in which alcoholic beverages of any kind are served, sold or consumed, provided, however, that the provisions of this section shall not apply to any minor under the age of eighteen (18) years who is accompanied by a parent or guardian.

SEC. 26.16. - Same—Permitting unaccompanied minors where alcohol prohibited.¶
No minor under the age of eighteen (18) years shall enter or remain in any public pool or billiard room in which alcoholic beverages of any kind are served, sold or consumed unless such minor is accompanied by a parent or guardian.

SEC. 26.17. - Same—Permitted for purposes other than pool or billiards.¶
The provisions of Sec. 26.15 and 26.16 shall not prohibit a minor under the age of eighteen (18) years from entering or remaining in any portion of a building containing a public pool or billiard room, in which alcoholic beverages of any kind are served, sold or consumed or in which the playing of cards is permitted pursuant to the provisions of Chapter 9 of the Mountain View City Code, without his parent or guardian, for any purpose or activity other than participating in or viewing the playing of pool or billiards; provided, however, that such purpose or activity is otherwise lawful; and provided, further, however, that such minor shall remain only so long as such purpose or activity shall require.

SEC. 26.18. - Same—Misrepresentation of age.¶
No minor under the age of eighteen (18) years, for the purpose of gaining entrance to any public pool or billiard room in which alcoholic beverages of any kind are served, sold or consumed, or in which the playing of cards is permitted pursuant to the provisions of Chapter 9 of the Mountain View City Code in violation of the provisions of Article II of this chapter, shall represent to the person owning, leasing or operating such pool or billiard room, or to the agent, employee, representative or concessionaire of such person, that such minor is eighteen (18) years of age or upwards.

SEC. 26.19. - Premises and activities to be open and in plain view of public.¶
All games of pool or billiards shall be carried on in a single room in plain view of all persons and shall be visible either from the public street or other portions of the building available to the public. If any beverages permissible by law are sold and consumed in such places, the same shall be in plain view of all persons, unobstructed by screens, blinds, stained windows or other device.

SEC. 26.20. - Hours of operation.¶
Rooms shall not be open, nor shall games be played therein, earlier than 6:00 a.m. of any day, nor later than 2:00 a.m. of the next day.

SEC. 26.21. - Regulations and prohibitions to be posted.¶
At least four (4) signs shall be posted and maintained in conspicuous places in and about all public pool or billiard rooms, printed in bold one inch high letters placed on a contrasting background, and setting forth the substance of the following provisions:
(1) No gambling, betting or wagering of any kind shall be suffered, allowed or permitted or engaged in by any person on the premises of the public pool or billiard room.
(2) No obscenity, oral, written or pictorial, of any kind shall be used, suffered, allowed or permitted or engaged in on the premises of any public pool or billiard room.
(3) The curfew hours for minors, as set forth in Sec. 21.3 to 21.8, shall be strictly observed and enforced on the premises of the public pool or billiard room.
(4) The owners, managers and operators, and each of them, of the public pool room or billiard room shall be strictly responsible for the enforcement of all provisions in this article, and shall not permit any person violating any of such provisions to remain in such public pool or billiard room.

SEC. 26.22. - Revocation or suspension of permit.¶
Any permit issued pursuant to this article may be revoked or suspended for a period not to exceed six (6) months by the chief of police for the violation of any of the provisions of this article.

SEC. 26.23. - Applicability of article.¶
The provisions of this article shall not apply to any premises owned or controlled by the city nor to any officials nor employees of the city while engaged in the operation or maintenance of any pool or billiard room on such premises.
