5.12.180 - Location restrictions.

An organization authorized to conduct bingo games shall conduct such games only on property owned or leased by it, and which property is used by such organization for an office or for performance of the purposes for which the organization is organized. Nothing in this chapter shall be construed to require that the property owned or leased by the organization be used or leased exclusively by such organization.

5.12.190 - Equipment ownership.

All equipment used in the operation of bingo games shall be owned by the organization authorized by permit and license to conduct such bingo games.

5.12.200 - Public accessibility.

All bingo games shall be open to the public, not just to the members of the nonprofit charitable organization.

5.12.210 - Staffing and operation.

A bingo game shall be operated and staffed only by members of the authorized organization which organized it. Such members shall not receive a profit, wage or salary from any bingo game. Only an organization authorized to conduct a bingo game by permit and license issued pursuant to this chapter shall operate such game, or engage in the promotion, supervision or any other phase of such game.

5.12.220 - Hours.

No permittee shall conduct any bingo game more than six hours out of any twenty-four-hour period. No bingo game shall be conducted before ten a.m. nor after twelve midnight.

5.12.230 - Physical presence required.

No person shall be allowed to participate in a bingo game unless such person is physically present at the time and place at which the bingo game is being conducted.

5.12.240 - Prize limitations.

The total value of prizes awarded during the conduct of any bingo games shall not exceed the limits established within the California State Penal Code Section 326.5.

5.12.250 - Financial interest limited to authorized organization.

No individual, corporation, partnership or other legal entity except the organization authorized by the permit and license to conduct a bingo game shall hold a financial interest in the conduct of such bingo game.

5.12.260 - Disposition of profits.

All profits derived from a bingo game shall be kept in a special fund or account and shall not be commingled with any other fund or account.

5.12.270 - Recordkeeping.

Each organization conducting a bingo game shall maintain detailed records of all profits, expenditures, prizes and other expenses associated with the operation of bingo games. The records shall be retained for such period of time as required by state and federal law and for a period of three years for the purposes of this chapter.

5.12.280 - Inspection of premises and records—Authority.

A. The chief of police shall have the authority to inspect the premises in order to insure that the operation of bingo games at the premises does not constitute a violation of any state or federal law or provision of this chapter.

B. The chief of police may inspect the records and special bank accounts containing profits derived from bingo games of any organization conducting bingo games whenever deemed reasonable and appropriate to insure compliance with the provisions of this chapter.

5.12.290 - Participation by minors.

No minors shall be allowed to participate in any bingo game.

5.12.300 - Compensation limited to prizes.

No person or agent of such person shall receive a profit, wage, salary or other income from any bingo game authorized by this chapter, except as a bona fide prize(s) received as a participant in such bingo game.

5.12.310 - Chapter provisions supplement state statutes.

The provisions of this chapter are not intended to conflict with, but shall supplement all laws of the state relating to lotteries, gaming or gambling.

5.12.320 - Violation.

It is unlawful for any person to violate any provisions of this chapter.
