Moraga Municipal Code § 1 Modification of Uniform Building Code

Under the authority of Sections 50020 et seq. of the Government Code, the Town of Moraga adopted Ordinance No. 48 on February 20, 1980, which incorporated by reference those provisions of the 1979 Uniform Building Code as adopted by the Board of Supervisors of Contra Costa County on January 15, 1980. That prior adoption by reference is hereby modified by the following amendments.
A. A new Article 74-3.32 is added to Title 7 (Building Regulations), Division 74 (Uniform Building Code) of the Contra Costa County Ordinance Code as adopted by the Town by reference to read:

74-3.3202 UBC Sec. 3203(b), Fire Retardancy, When Required, is amended by adding a new subsection 4. to read:
"4. A new roof for a structure with an occupancy classification of: R-Division 1 (hotels and apartment houses); R-Division 3 (dwellings and lodging houses) if 2 or more of the dwellings are attached; or M, if associated with above occupancies; shall have a fire rating of Class C or better."
74-3.3210 UBC Section 3210, Inspections, of Appendix Chapter 32 (Re-Roofing) is amended to read:
"Sec. 3210. New roof coverings shall not be applied without first obtaining an inspection and written approval from the building official A final inspection and approval shall be obtained from the building official when the re-roofing is complete.
A building permit is required for a re-roofing of a structure with an occupancy classification of:
R-Division 1 (hotels and apartment houses)
R-Division 3 (dwellings and lodging houses) if 2 or more dwellings are attached; or M, if associated with above occupancies.
The fire rating of the roofing material for such a re-roofing shall be Class C or better."
B. A new Article 74-3.37 is added to Title 7 (Building Regulations), Division 74 (Uniform Building Code) of the County Ordinance Code as adopted by the Town by reference:
"Article 74-3.37

74-3.3703 UBC Section 3703 (Chimneys, General) subsection (f), Height and Termination, is amended to read:
"(f) Height and Termination. Every chimney shall extend above the roof and the highest elevation of any part of a building as shown in Table No. 37-B. For altitudes over 2000 feet, the building official shall be consulted in determining the height of the chimney.
When alterations, repairs or additions to any portion of the structure requiring a permit occur, a spark arrester shall be provided on each (existing and new) chimney.
All incinerator chimneys shall terminate in a substantially constructed spark arrester having a mesh not exceeding ½ inch.
As used in this section, a spark arrester is defined as a device constructed of nonflammable material , 12 gauge minimum welded or woven wire mesh, with ½ inch openings, or cast iron plate, minimum thickness or other material found satisfactory by the enforcement agency, and not exceeding ½ inch perforations for arresting burning carbon or sparks installed in such a manner as to be visible for the purposes of inspection and maintenance."
