A. In addition to the taxes imposed pursuant to the other provisions hereof, the following fees are imposed:

1. Every person constructing a new dwelling unit, or one-family dwelling, shall pay a fee in the amount of one thousand two hundred six dollars and twelve cents for each dwelling unit, or one-family dwelling; and

2. Every person who files for approval, a subdivision map having the effect of creating a condominium, as to an existing apartment house, shall pay a fee of one thousand two hundred six dollars and twelve cents for each dwelling unit shown on such map; and

3. Every person who constructs or establishes a mobile house park, having one or more trailer sites therein, shall pay a fee of six hundred ninety-three dollars and eighty-seven cents for each trailer site.

B. The phrases "dwelling unit," "one-family dwelling," and "mobile home park" shall be defined for purposes of this section as set forth in title be defined for purposes of this section as set forth in title of this code.

C. All fees imposed, pursuant to subsection (A)(1) and (3) of this section, shall be paid prior to the issuance of a building permit for such projects, fees imposed, pursuant to subsection (A)(2) of this section, shall be paid prior to the approval and recordation of a final subdivision tract map.

D. Notwithstanding any other provision of this section no such fee shall be required for any housing development or project funded, in whole or part, under the provisions of Section 236 of the National Housing Act, as amended.

E. The fee imposed by this section shall be increased or decreased annually as of July 1 of each calendar year, commencing on July 1, 1979, in an amount equal to the increase or decrease from the base index in the then latest available consumer price index, as prepared and released by the U.S. Department of Labor, Bureau of Statistics, for the Los Angeles-Riverside-Orange County area. The last index published for the month of June 1978 shall be deemed to be the base index for the purpose of this section.

Notwithstanding the provision of Section 3.24.010(A) of this code, during the period July 1, 2009, through and including June 30, 2010, the development impact fee to be collected pursuant to that section shall not exceed the following:

A. Development impact fee. In addition to the taxes imposed pursuant to the other provisions of this chapter, the following fees are hereby imposed:

1. Every person constructing a new dwelling unit, or one-family dwelling, shall pay a fee in the amount of one thousand two hundred six dollars and twelve cents for each dwelling unit, or single-family detached dwelling; and

2. Every person who files for approval, a subdivision map having the effect of creating a condominium, as to an existing apartment house, shall pay a fee of one thousand two hundred six dollars and twelve cents for each dwelling unit shown on such map; and

3. Every person who constructs or establishes a mobile house park, having one or more trailer sites therein, shall pay a fee of six hundred ninety-three dollars and eighty-seven cents for each trailer site.

B. That during such time as this section of the Montebello Municipal Code is in effect, the amount of the development impact fee imposed by said Section 3.24.010(A) contrary to the amount above set forth, shall be suspended, and shall not be collected.
