12.02.010 - Purpose.

The Monte Sereno Cultural Commission (hereinafter referred to as the "Commission") is hereby established and created.

12.02.020 - Membership and criteria for appointment.

A. The Commission shall consist of seven (7) members, each of whom shall serve for terms of two (2) years.

B. All members of the Commission shall be residents and registered voters of the City.

12.02.030 - Appointment process.

A. Each member of the City Council shall appoint one member of the Commission. The remaining two (2) members of the Commission shall be appointed by a majority vote of the City Council.

B. Member terms shall be staggered so that no more than four (4) terms will expire in any one calendar year. For purposes of appointing members to the first Commission, four (4) members shall be appointed to serve terms expiring January 1, 2006, and three (3) members shall be appointed to serve terms expiring January 1, 2005. Thereafter, appointments shall be made for two- (2) year terms.

12.02.040 - Removal process.

Any member of the Commission may be removed for the following reasons:

A. The member ceases to be a resident of the City.

B. The member fails to attend three (3) consecutive regular Commission meetings without an approved excuse by the Commission.

C. The member is removed by a majority vote of the City Council.

12.02.050 - Commission duties and responsibilities.

The Commission shall advise the City Council on cultural events, issues and opportunities within the City. Cultural events, issues and opportunities that the Commission may address include, but are not limited to, quarterly community events, City's annual picnic, visual and performing arts event development, colorectal cancer awareness outreach, community newsletter, senior/junior programs, update history of Monte Sereno publication, historic preservation education, and a citizens of distinction program.

12.02.060 - Rules and procedures.

The Commission may adopt rules and procedures governing the actions of the Commission. Before the rules and procedures become final they must be filed with the City Clerk and approved by the City Council.

12.02.070 - Commission officers.

The Commission shall elect one member of the Commission to serve as Chairperson of the Commission for a period of one year. The Commission shall elect one member of the Commission to serve as Vice Chairperson of the Commission for a period of one year. The Commission shall elect one member of the Commission to serve as the Secretary for the Commission and shall be responsible for providing Commission meeting notices and maintaining the records of the Commission, including minutes of Commission meetings. For purposes of electing these offices for the first Commission, the Chairperson, Vice Chairperson and Secretary shall serve a term that shall terminate on December 31, 2004. Thereafter, each term will run from January 1st to December 31st.

12.02.080 - Cultural Commission meetings.

The Council shall set the date and time for Commission meetings by resolution. The Commission shall meet no less frequently than once a month. All meetings shall be open to the public. The Commission may call a special meeting at any time in accordance with Government Code Section 54956.

12.02.090 - The conduct of business.

In order to conduct business, a quorum of the Commissioners must be present at a noticed meeting. A quorum is defined as a majority of the number of Commissioners seated at any one time, but in no event less than three (3) Commissioners.
