Monrovia Municipal Code Ch. 6.08 Definitions

Whenever in this title, the terms set out in §§ 6.08.030 through 6.08.170 are used, they shall have the meaning ascribed to them in this chapter unless it is apparent from the context or use thereof that some other meaning is intended.

The terms set forth in this chapter are as defined in §§ 6.08.030 through 60.80.170.

ANIMALS shall include horses, ponies, mules, burros, jacks and jennies, cows, bulls, calves, heifers, sheep, goats, swine, hogs, pigs, and all other domestic animals other than household pets.

BARKING shall mean an abrupt, harsh, explosive cry of a dog, howling or baying, by day or night, at frequent intervals or for extended periods of time. Barking shall not include a dog barking when in the act of protecting against or resisting a trespasser to the premises upon which the dog is kept, harbored or otherwise maintained. The burden of proof shall be upon the owner, keeper, harborer, or maintainer of the dog to establish barking in the act of protecting against or resisting a trespasser.

CATTERY shall mean any lot or premises on which five or more cats over four months of age are kept, boarded or maintained for any purpose, whether or not for compensation.

CATS shall mean any domestic or feral animal that is a member of the feline family.

DOG KENNEL shall mean any lot or premises on which four or more dogs over four months of age, are kept, boarded or maintained for any purpose.

DOGS shall mean any domestic animal that is a member of the canine family.

DOMESTIC ANIMAL shall mean any animal tamed to live and breed in close association with human beings such that the animal loses its ability to live in the wild.

HOUSEHOLD PETS shall include cats, dogs, Vietnamese pot-bellied pigs, canaries, parrots, and other kindred birds, and animals usually or normally maintained within a residence.

KEEP shall mean possessing, controlling, exercising or allowing to run at large any animal or household pet and/or feeding, caring for, or providing veterinary care for a cat.

LICENSING AUTHORITY shall mean the Animal Control Officer or any person authorized or designated to issue a license and tag and collect the fee therefor.

OWNER shall mean any person, firm or corporation owning, having an interest in, having the control, custody or possession of any animal or household pet, and in the case of a licensed dog, shall be presumed to be the person to whom the license is issued.

RABBITS, POULTRY AND DOMESTIC FOWLS shall include any member of the hare family, chinchillas, hamsters, nutria, guinea pigs, and other rodents, pigeons, chickens, chicks, capons, ducks, geese, turkeys, doves, squab, and all other domestic fowls bred for meat product, egg laying, or purely for ornament or show.

UNLICENSED DOG shall mean any dog for which the license for the current licensing year has not been paid, or to which the tag for the current year provided for in this law is not attached.

VICIOUS ANIMAL shall mean any animal which has bitten a person or other animal without provocation or which has a propensity to attack any person or animal without provocation.

WILD ANIMAL shall mean any animal not ordinarily and customarily a domestic animal, either under or not under human control.
