11.04.010 - Definitions.

Except as specifically provided herein, the words used in this chapter shall be as defined in the California Vehicle Code.

11.04.020 - Traveled way.

The traveled way shall be not less than eleven feet on one-way roads, the roads being so marked by signs, or less than twenty-two feet on all other roads. The traveled way is equally spaced on both sides of the centerline.

11.04.025 - Parking for twenty-four or more hours—Prohibited where.

No person shall park or leave standing any vehicle for twenty-four or more consecutive hours in the following areas:

A. On the east side of Lakeview Drive in June Lake from the southwest corner of Lot 16, Block 15, Silver Lake Pines, Tract No. 1, northerly to State Route No. 158.

11.04.030 - Parking for eighteen or more hours—Prohibited where.

No person shall park or leave standing any vehicle for eighteen or more consecutive hours, April 1st through October 31st, on sides of State Route No. 158 in the following area: State Route No. 158, commencing at the intersection of said State Route No. 158 and the northerly end of Lakeview Drive and continuing southerly to the intersection of State Route 158 and Gull Lake Drive, June Lake, California.

11.04.035 - Parking for two or more hours.

No person shall park or leave standing any vehicle for two or more consecutive hours between the hours of six a.m. and twelve p.m. along that portion of the southwest side of State Route 158 from the southerly end of Lakeview Drive northerly to the June Lake Post Office (that portion of State Route 158 immediately adjacent to the United States Post Office is limited to thirty minutes parking at all times); and further along the northeast side of State Route 158 from the northerly end of Lakeview Drive southerly to the intersection of State Route 158 and Gull Lake Drive, June Lake, California.

11.04.040 - No parking zones designated.

No person shall stop, park or leave standing any motor vehicle whether attended or unattended, except when necessary to avoid conflict with other traffic or in cases of emergency or in compliance with the directions of a peace officer or traffic control device, in any of the following designated areas:

A. The east side of Knoll Avenue from the intersection of State Route 158 north to the intersection of Bruce Street, the south side of Bruce Street west to the intersection of Granite Street, both sides of Granite Street south to the intersection of State Route No. 158, June Lake, California;

B. The east side of Lakeview Drive from the southwest corner of Lot 16, Block 15, Silver Lake Pines Tract No. 1, to State Route No. 158, June Lake, California;

C. The south side of U.S. 395 in the town of Bridgeport, between Hayes Street and Twin Lakes Road, between the hours of two a.m. and seven a.m., December 1st to March 31st;

D. The south side of State Route No. 158 in June Lake, from one hundred feet to three hundred feet southwesterly of the intersection of State Route No. 158 and the south line of Silver Lake Pines Tract No. 4; being in the southwest ¼ of the northeast ¼ of Section 21, Township 2 South, Range 26 East M.D.M.; provided, however, parking shall be open to and restricted to school buses of the Eastern Sierra Unified School District;

E. Twin Lakes Road (County Road No. 420) from the end of the road at Mono Village to a point one hundred feet east;

F. Both sides of Bryant Street, in Bridgeport, from Sinclair Street on the west to its terminus behind the Walker River Lodge;

G. Crawford Avenue in June Lake from Knoll Avenue to Alderman Street;

H. Alderman Street in June Lake from Granite Avenue to Foster Avenue;

I. Foster Avenue in June Lake from Crawford Avenue to Alderman Street;

J. State Route No. 158 from Milepost 6.5 (U.S.F.S. Silver Lake South Parking Area) to Milepost 7.0 (Alger Creek, U.S.F.S. Silver Lake North Parking Area) is prohibited;

K. The northeast side of Crowley Lake Drive, County Road No. 2005, in Long Valley, (north end of Crowley Lake Drive) from Station 61+00 to Station 71+00; provided, however, parking shall be open to and restricted to school buses of the Eastern Sierra Unified School District;

L. State Route 395, Main Street, in Bridgeport, California, from the East Walker River bridge to the Rickey Ditch Overflow bridge in the areas described as follows:

  1. Beside any curb within any public road intersection;

  2. Within twenty feet of any public road intersection measured from the crosswalk, or, in the absence of a marked crosswalk, along the straight section of curb from the curb return, except as stated in subdivision 7 of this subsection;

  3. Within twenty feet of any crosswalk between intersections, except as stated in subdivision 7 of this subsection;

  4. Within six feet of any private driveway measured along curb of full height, except as stated in subdivision 7 of this subsection;

  5. Within fifteen feet of any fire hydrant, except as stated in subdivision 7 of this subsection;

  6. Within any area less than twenty feet long between the locations described above;

  7. The section of curb between any two adjacent areas described in this subsection shall be measured in the direction of traffic, beginning at the area closest to approaching traffic, and the number of normal parking stalls that would fit shall be determined, end stalls being twenty feet long and intermediate stalls being twenty-two feet long; any distance that would not be utilized by parking stalls shall be added to the area at the end of the section furthest from approaching traffic;

  8. The section of curb on the north side of Main Street from a point of five hundred feet east of the intersection of Main and Kirkwood Streets to the intersection of Main and Kirkwood Streets.

M. State Route 395, in Lee Vining, California from Utility Road (Post Mile 51.007) to the Mono Lake Visitor Center driveway (Post Mile 51.898) in areas as follows:

  1. Beside any curb within any public road intersection;

  2. Within twenty feet of the approach side and six feet from the departure side of any public road intersection measured from the crosswalk, or, in absence of a marked crosswalk, along the straight section of curb from the curb return, except as stated in subdivision 7 of this subsection; provided, however, that on the west side of State Route 395 southbound between 4th Street and Lee Vining Avenue, the foregoing parking restrictions shall apply only to the northerly fifteen feet and the southerly six feet of State Route 395;

  3. Within twenty feet of the approach side and six feet from the departure side of any crosswalk between intersections, except as stated in subdivision 7 of this subsection;

  4. Within six feet of any private driveway measured along curb of full height, except as stated in subdivision 7 of this subsection;

  5. Within fifteen feet of any fire hydrant, except as stated in subdivision 7 of this subsection;

  6. Within any area less than twenty feet long between the locations described above;

  7. The section of curb between any two adjacent areas described in this subsection shall be measured in the direction of traffic, beginning at the area closest to approaching traffic, and the number of stalls being twenty feet long and intermediate stalls being twenty-two feet long; any distance that would not be utilized by parking stalls shall be added to the area at the end of the section furthest from approaching traffic;

  8. The area on the westerly side of State Route 395 from a point five hundred feet south of the intersection of State Route 395 and Lee Vining Avenue to the intersection of State Route 395 and Lee Vining Avenue.

N. State Route 158, in June Lake, California, from a point one thousand feet north of the intersection of State Route 158 and the northerly end of Lakeview Drive southerly to a point one thousand feet south of the intersection of State Route 158 and Gull Lake Drive areas as follows:

  1. Beside any curb within any public road intersection;

  2. Within fourteen feet of the approach side and six feet from the departure side of any public road intersection measured from the crosswalk, or, in absence of a marked crosswalk, along the straight section of curb from the curb return, except as stated in subdivision 7 of this subsection;

  3. Within twenty feet of the approach side and six feet from the departure side of any crosswalk between intersections, except as stated in subdivision 7 of this subsection;

  4. Within seven feet of any fire hydrant, except as stated in subdivision 7 of this subsection;

  5. Within any area less than twenty feet long between the locations described above; except for the designated twelve-foot space directly across from the United States Post Office;

  6. The section of curb between any two adjacent areas described above shall be measured in the direction of traffic, beginning at the area closest to approaching traffic, and the number of stalls being twenty feet long and intermediate stalls being twenty-two feet long; any distance that would not be utilized by parking stalls shall be added to the area at the end of the section furthest from approaching traffic;

  7. The area of the westerly side of State Route 158 from the intersection of State Route 158 and the southerly end of Lakeview Drive to the intersection of State Route 158 and Gull Lake Drive.

O. Northshore Drive from its intersection with State Highway 158 at Oh! Ridge to its intersection with State Highway 158 near the June Lake Ski Area.

P. Both sides of the Lower Rock Creek Road "hairpin turn," by the former Rock Creek Lodge, County Road No. 2001, formerly Hwy. 395, in the Paradise community; being in the west ½ of the Southwest ¼ corner of Section 29, Township 5 South, Range 31 East, M.D.B.& M., along said road centerline from 250 feet southeasterly of the Tract Map No. 37-59 subdivision access road "Upper Canyon Road" intersection to 300 feet southwesterly of the subdivision access road "Lower Canyon Road" intersection; provided, however, parking shall be open to and restricted to school buses of the Eastern Sierra Unified School District and other public transit buses serving said road.

11.04.050 - Exceptions.

Vehicles, trailers, semitrailers and other wheeled or skidded vehicles authorized under Article 2, Chapter 5, Part 1, Division 1 of the Public Utilities Code, laws of the state, any and all emergency vehicles, and any and all vehicles owned, operated or otherwise controlled by the Mono County road department are excepted from the provisions of Section 11.04.040.

11.04.060 - Removal, notice and hearing.

A. A peace officer, as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of the California Penal Code (hereafter "officer"), or any regularly employed and salaried employee of Mono County engaged in directing traffic or enforcing parking laws and regulations of the county (hereafter "employee") may remove a vehicle which is parked, stopped, left standing, or otherwise left in violation of this chapter, provided that the vehicle is located within the territorial limits in which the officer or employee may act.

For the purposes of this chapter, employee means the county director of transportation, the county road operations manager, any county district road supervisor, and the county code compliance specialist. Notwithstanding their authority to direct removal, an employee designated by this section may refer a violation of this chapter to an officer for determination of whether removal is justified. If the officer directs the removal and/or storage of the vehicle, then the agency employing the officer shall be deemed to be the agency directing the removal and/or storage.

B. Whenever an officer or employee directs the storage of a vehicle pursuant to this chapter, the agency or officer directing the storage shall provide the vehicle's registered and legal owners of record, or their agents, with notice of the storage and the opportunity for a post storage hearing in accordance with Section 22852 of the California Vehicle Code.

  1. The notice shall be mailed or personally delivered to the registered and legal owners within forty-eight hours of storage, excluding weekends and holidays, and shall include all of the following information:

a. The name, address, and telephone number of the agency providing the notice;

b. The location of the place of storage and description of the vehicle, which shall include, if available, the name or make, the manufacturer, the license plate number, and the mileage;

c. The authority and purpose for the removal of the vehicle;

d. A statement that, in order to receive their post storage hearing, the owners, or their agents, shall request the hearing in person, writing, or by telephone within ten days of the date appearing on the notice.

  1. Post storage hearings shall be conducted within forty-eight hours of a request, excluding weekends and holidays. Any officer or employee, as defined above, excluding the officer or employee who directed the storage, may conduct the hearing.

  2. At the hearing, the agency directing the storage shall have the burden of establishing the authority for, and the validity of, the removal. If it is determined at the hearing that reasonable grounds for the storage were not established, then the agency directing the storage shall be responsible for the costs incurred for towing and storage.

C. If the officer or employee does not know and is not able to ascertain the name of the owner or for any other reason is unable to give notice to the owner as required by this section, then the officer shall immediately notify, or cause to be notified, the Department of Justice, Stolen Vehicle System, of the vehicle's removal in accordance with California Vehicle Code Section 22853.

D. If the vehicle removed to storage is determined to have a value not exceeding five hundred dollars pursuant to California Vehicle Code Section 22670, then the agency directing the storage shall comply with the procedures and requirements set forth in California Vehicle Code Section 22851.2.

E. In accordance with Section 22850.5 of the California Vehicle Code, the board of supervisors may adopt a resolution establishing procedures for the release of properly impounded vehicles and for the imposition of a charge equal to the administrative costs relating to the removal, impound, storage, or release of the vehicles.

11.04.070 - Signs authorized.

Regulation California highway signs shall be placed as necessary to indicate the parking permitted or prohibited by Sections 11.04.030 through 11.04.050.

11.04.080 - Angle parking zone designated.

No person shall stop, park or leave standing any motor vehicle, whether attended or unattended, except when necessary to avoid conflict with other traffic or in cases of emergency or in compliance with the directions of a peace officer or traffic-control device, all as provided in county Ordinance No. 72-407a, except on S.R No. 203 between Milepost 1 and Milepost 2, when properly signed. This parking will be angle parking according to said signs and other designations.

11.04.090 - Parking on portion of State Highway 9-Mno-158.

A. Prohibited Parking. The parking of vehicles on that portion of State Highway 9-Mno-158 in the town of June Lake as shown as solid (red) curb on the map attached to the ordinance codified in this chapter and on file with the clerk of the board of supervisors is prohibited.

B. Limited Parking. The parking of vehicles on that portion of said state highway, as shown as green curbing on said map, is restricted to limited parking only, and limited to the time as marked.

C. Removal. Any officer or county employee defined in Section 22651 of the Vehicle Code may, pursuant to the authority of Sections 22651, 22653 and 22654 of the code, remove any vehicle which is parked, stopped, left standing or otherwise left in violation of this section, to any public garage and/or county impound yard.

11.04.095 - Public parking in designated portions of Twin Lakes Area.

A. Parking is permitted in the area between upper and lower Twin Lakes as follows:

  1. In the seven designated parking stalls on the east side of North Patterson Drive, in that area east of the bridge between upper and lower Twin Lakes:

  2. In five designated parking stalls near the corner of Aspen and Lakeshore Drives.

B. Parking in the area between upper and lower Twin Lakes is restricted as follows:

  1. The number of vehicles in the area is limited to twelve, and parking must be within the designated areas described in subsection A of this section;

  2. Parking is limited to passenger cars, pickup trucks and similar vehicles. Parking of motorhomes, travel-trailers, or other recreational vehicles with chassis-mounted living quarters is prohibited;

  3. Parking in the designated areas is limited to the hours of five a.m. to nine p.m. daily.

C. No parking is permitted in remaining adjacent areas, which are tow-away zones, as designated and signed.

D. Removal. Any officer or county employee defined in Section 22651 of the Vehicle Code may, pursuant to the authority of Sections 22651, 22653 and 22654 of the code, remove any vehicle which is parked, stopped, left standing or otherwise left in violation of this section, to any public garage and/or county impound yard.

E. Notwithstanding the provisions of subsection A of Section 11.04.100, violation of this section is an infraction. The minimum fine for a first violation shall be fifty dollars. The remaining provisions of Section 11.04.100 are applicable.

11.04.100 - Violation—Penalty—Enforcement.

A. Any person violating the parking prohibitions of this chapter shall be guilty of an infraction and subject to a fine, and late payment penalties as applicable, in those amounts set forth by resolution adopted by the board of supervisors. Each calendar day that a vehicle is left parked or standing in an area prohibited for parking by this chapter shall be considered a separate violation.

B. The provisions of this chapter, as well as the provisions of California Vehicle Code Sections 22500, 22502, 22505, 22507.8(a), 22510, 22514, 22515 and 22522, may be enforced by the parking/boating safety officer designated by the sheriff of Mono County.
