Chapter 11.05 — PARKING ON COUNTY ROADS

11.05.010 - Prohibited when.¶
The parking or standing of vehicles in designated areas on the road side of the snow stakes along any county road from November 1st through April 15th is prohibited.

11.05.020 - Removal, notice and hearing.¶
A.
A peace officer, as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of the California Penal Code (hereafter "officer"), or any regularly employed and salaried employee of Mono County engaged in directing traffic or enforcing parking laws and regulations of the county (hereafter "employee") may remove a vehicle which is parked, stopped, left standing, or otherwise left in violation of this chapter, provided that the vehicle is located within the territorial limits in which the officer or employee may act.
For the purposes of this chapter, employee means the county director of transportation, the county road operations manager, any county district road supervisor, and the county code compliance specialist. Notwithstanding their authority to direct removal, an employee designated by this section may refer a violation of this chapter to an officer for determination of whether removal is justified. If the officer directs the removal and/or storage of the vehicle, then the agency employing the officer shall be deemed to be the agency directing the removal and/or storage.
B.
Whenever an officer or employee directs the storage of a vehicle pursuant to this chapter, the agency or officer directing the storage shall provide the vehicle's registered and legal owners of record, or their agents, with notice of the storage and the opportunity for a post storage hearing in accordance with Section 22852 of the California Vehicle Code.
The notice shall be mailed or personally delivered to the registered and legal owners within forty-eight hours of storage, excluding weekends and holidays, and shall include all of the following information:
a.
The name, address, and telephone number of the agency providing the notice;
b.
The location of the place of storage and description of the vehicle, which shall include, if available, the name or make, the manufacturer, the license plate number, and the mileage;
c.
The authority and purpose for the removal of the vehicle;
d.
A statement that, in order to receive their post storage hearing, the owners, or their agents, shall request the hearing in person, writing, or by telephone within ten days of the date appearing on the notice.
Post storage hearings shall be conducted within forty-eight hours of a request, excluding weekends and holidays. Any officer or employee, as defined above, excluding the officer or employee who directed the storage, may conduct the hearing.
At the hearing, the agency directing the storage shall have the burden of establishing the authority for, and the validity of, the removal. If it is determined at the hearing that reasonable grounds for the storage were not established, then the agency directing the storage shall be responsible for the costs incurred for towing and storage.
C.
If the officer or employee does not know and is not able to ascertain the name of the owner or for any other reason is unable to give notice to the owner as required by this section, then the officer shall immediately notify, or cause to be notified, the Department of Justice, Stolen Vehicle System, of the vehicle's removal in accordance with California Vehicle Code Section 22853.
D.
If the vehicle removed to storage is determined to have a value not exceeding five hundred dollars pursuant to California Vehicle Code Section 22670, then the agency directing the storage shall comply with the procedures and requirements set forth in California Vehicle Code Section 22851.2.
E.
In accordance with Section 22850.5 of the California Vehicle Code, the board of supervisors may adopt a resolution establishing procedures for the release of properly impounded vehicles and for the imposition of a charge equal to the administrative costs relating to the removal, impound, storage, or release of the vehicles.

11.05.030 - Towing charges.¶
The charges for towing and storage for vehicles removed pursuant to the ordinance codified in this chapter shall be such reasonable charges as may be approved by the board of supervisors of the county from time to time by resolution.

11.05.040 - Designated areas.¶
Designated areas shall be:
A.
Those areas described in a resolution adopted by the board of supervisors and posted in accordance with applicable law, including notice that vehicles may be towed;
B.
The following areas within the community of Hot Creek, provided that signs are posted in accordance with applicable law, including notice that vehicles may be towed:
Airport Road;
Hot Creek Hatchery Road;
Mt. Morrison Road;
School Road;
Substation Road;
Convict Lake Road;
Benton Crossing Road;
Pit Road.
C.
The following areas within the community of Sunny Slopes, provided that signs are posted in accordance with applicable law, including notice that vehicles may be towed:
Montana Road;
Sunny Slope Road;
Wheeler View Drive;
Owens Gorge Road.
D.
The following areas within the community of Tom's Place, provided that signs are posted in accordance with applicable law, including notice that vehicles may be towed:
Rock Creek Road;
Rainbow Tarns Road.
E.
The following areas within the community of Aspen Springs, provided that signs are posted in accordance with applicable law, including notice that vehicles may be towed:
Aspen Springs Ranch Road.
F.
The following areas within the community of Swall Meadows, provided that signs are posted in accordance with applicable law, including notice that vehicles may be towed:
Foothill Road;
Meadow Road;
Mountain View Drive;
Orchard Road;
Pine Drive;
Quail Circle;
Pinion Drive;
Rimrock Drive;
Swall Meadows Road;
Valley View Drive;
Valley View Road;
Willow Road;
Wilson Road;
Sierra Wave;
Sky Meadows Road;
Ridge View;
Cougar Run;
Lower Rock Creek Road.
G.
The following areas within the community of Crowley Lake, provided that signs are posted in accordance with applicable law, including notice that vehicles may be towed:
Aspen Terrace;
Crowley Circle;
Delta Drive;
Elderberry Lane;
Gregory Lane;
Hilton Creek Drive;
Hilton Creek Place;
Lake Manor Place;
Placer Road;
Meadow View Drive;
Pearson Road;
Wild Rose;
Sierra Springs Drive;
Larkspur Lane;
Shanna Circle;
Larkspur Drive;
Red Bluff Trail;
Lakeridge Trail;
Cimmaron Circle;
South Landing Road;
Hidden Canyon Court.
H.
All of Crowley Lake Drive, provided that signs are posted in accordance with applicable law, including notice that vehicles may be towed.

11.05.050 - Preferential parking areas.¶
Preferential parking areas may be established by resolution of the board of supervisors of the county and are effective only when properly signed.

11.05.060 - Penalties.¶
In addition to, or in lieu of, removal as set forth in Section 11.04.060, any person cited for violation of this chapter shall be guilty of an infraction and subject to a penalty, and late payment penalties if applicable, in those amounts set forth by resolution adopted by the board of supervisors. Each calendar day that a vehicle is left parked or standing in violation of this chapter shall be considered a separate violation.
