9.05.010 - Policy.

The county board of supervisors adopts and approves the military equipment use policy, otherwise known as the Modoc County Sheriff's Office Lexipol Policy 707.

9.05.020 - Findings.

In adopting and approving Lexipol Policy 707, the county board of supervisors makes the following findings:

A. The above recitals are true and correct and incorporated herein.

B. The Sheriff's Office Lexipol Policy 707 will safeguard the public's welfare, safety, civil rights, and civil liberties.

C. The military equipment identified in the Modoc County Sheriff's Office Lexipol Policy 707 is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.

D. The military equipment identified in the Modoc County Sheriff's Office Lexipol Policy 707 is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety.

E. Prior military equipment use either complied with the military equipment use policy that was in effect at the time, or if prior uses did not comply with the accompanying military equipment use policy, corrective action has been taken to remedy nonconforming uses and ensure future compliance.

9.05.030 - Transparency.

Lexipol Policy 707 shall be made publicly available on the county sheriff's office internet website for as long as the military equipment is available for use.

9.05.040 - Review of policy.

The board of supervisors shall review this chapter at least annually and, in accordance with Assembly Bill 481, vote on whether to renew this chapter.
