3-7.01 - Definitions.¶
Whenever the following terms are used in this chapter, they shall have the meaning ascribed to them in this section, unless otherwise apparent from the context.
(a) "Chief" shall mean Chief of Police;
(b) "Reserve" shall mean the Modesto Police Reserve;
(c) "Member" shall mean a member of the Modesto Police Reserve.

3-7.02 - Creation of Modesto Police Reserve.¶
The Modesto Police Reserve is hereby created. The members of the Reserve shall be appointed by the City Manager and shall be under the direction and control of the Chief.

3-7.03 - Qualifications.¶
The City Manager, by rule, shall prescribe the qualification and standards by which applicants for membership in the Reserve shall be governed, and persons possessing these qualifications and conforming to these standards may be appointed to the Reserve by the City Manager.

3-7.04 - Public Services to be Rendered as Ordered by Chief.¶
Members shall perform only such public service as a member of the Reserve as may be ordered by the Chief, and it shall be unlawful for any person to wilfully resist, delay, or obstruct any member in the discharge or the attempt to discharge any duties of his office.

3-7.05 - Enforcement Powers.¶
In the enforcement of the penal laws of the State, or the penal laws of the City, and in the performance of such other duties as may be designated by the Chief, every duly authorized member of the Reserve shall be deemed to have all the powers of a peace officer.

3-7.06 - Uniform and Equipment.¶
The uniform, badge, and equipment to be worn and carried by the members shall be prescribed by the Chief. Except as otherwise provided in this section, the uniform, badge, and other equipment shall be purchased by the member at his own expense, provided, however, that upon the separation of any person from the Reserve, the badge, identification card, and cap piece issued to him shall be returned to the Chief, and the member so returning his badge shall be entitled to no compensation therefor. The City is hereby authorized to furnish the uniform, badge, and equipment of the members out of the public funds upon approval of the Council. Title to all property furnished to members of the Reserve by the City shall remain in the City.

3-7.07 - Unlawful to Impersonate Reserve Officer.¶
It shall be unlawful for any person to impersonate or falsely represent himself to be a member, or to wear, use, or possess a badge used by the Reserve.

3-7.08 - City Manager May Dismiss Reserve Member.¶
The City Manager may dismiss a member from the Reserve without any hearing whatsoever and each member shall have the right to resign from said Reserve at any time.

3-7.09 - Eligibility for Membership.¶
To be eligible for membership in the Reserve, each applicant must indicate his willingness to serve an average minimum number of hours per month in the public service as prescribed by the Chief, and when any member fails to serve said minimum number of hours as required by the rules, the Chief shall inquire into the reasons therefore, and unless good reason is shown for said failure to render the minimum number of hours herein required, the Chief may recommend to the City Manager the dismissal of the member from the Reserve.

3-7.10 - Reserve Members Deemed Public Officers.¶
Each member of the Reserve shall be deemed to be a public officer.

3-7.11 - Members Shall Be Registered with Disaster Council.¶
Each member of the Reserve shall be registered with the City civil defense and disaster organization.

3-7.12 - Rules and Regulations.¶
The Chief is hereby authorized, directed, and empowered to prepare and promulgate such rules and regulations and revisions and amendments thereof as in his discretion may be necessary to carry out the provisions of this Chapter.

3-7.13 - Status of Existing Police Reserve Members.¶
Any person who, on the effective date of this Chapter, is a member of the existing Modesto Police Reserve shall automatically continue as a member of the Reserve subject to the provisions of this Chapter.
