Milpitas Municipal Code Ch. 14 City Council Salaries

The Ordinance codified in this chapter is enacted pursuant to Section 36516 of the Government Code, as amended, authorizing the Council to provide by ordinance that each member of the Council shall receive a prescribed salary, the amount of which is based upon the population of the City as determined by estimates made by the State Department of Finance, and prescribing the methods by which Council salaries may be increased or decreased in the future. Government Code Section 36516.1 authorizes additional compensation for a Mayor elected pursuant to Section 34900 et. seq. as may be approved by an ordinance adopted by the City Council.

Each member of the City Council shall receive as salary the following:

A. City Council members shall receive the sum of $904.37 dollars per month.

B. The Mayor of the City of Milpitas shall receive the sum of $1,130.75 dollars per month.

The salaries provided in this Chapter may be increased or decreased as follows:

A. Following any new and later estimate of population made by the Department of Finance, the salary payable to each member of the Council may be increased or decreased by resolution of the City Council to equal the sum prescribed for that population group in Section 36516 of the Government Code as amended.

B. An amount equal to five percent for each calendar year from the operative date of the last adjustment of the salaries in effect, in accordance with Government Code Section 36516(c) and as approved by City Council resolution.

C. In accordance with Government Code Section 36516(b), by a majority of the electors voting at any municipal election.

D. The salaries as so increased or decreased shall become payable only on and after the date upon which one or more members of the Council becomes eligible upon beginning a new term of office following a general municipal election held in the City.

The salaries prescribed herein are and shall be exclusive of any amounts payable to each member of the Council as reimbursement for actual and necessary expenses incurred by him in the performance of official duties for the City of Milpitas.
