Merced Municipal Code Ch. 10.28 Stopping, Standing and Parking

A. The provisions of this chapter prohibiting the stopping, standing or parking of a vehicle shall apply at all times or at those times specified in this chapter, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic-control device.

B. The provisions of this chapter imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restrictive provisions of the state Vehicle Code, this code or other ordinances of this city, prohibiting of limiting the standing or parking of vehicles in specified places or at specified times.

No person shall stop, stand or park a vehicle within any parkway.

(Prior code § 16.42).

No person shall park or stand a vehicle which is seven (7) feet or more in height (including any load thereon) on any street or highway within one hundred (100) feet of any intersection within the city.

No person shall park or stand a vehicle on any street or highway within ten (10) feet of an open-end cul-de-sac and other similar access ways to bicycle paths.

No person who owns or has possession, custody or control of any vehicle shall park such vehicle upon any street, alley or city parking lot for a consecutive period of more than seventy-two (72) hours.

In the event a vehicle is parked or left standing upon a street in excess of a consecutive period of seventy-two (72) hours in violation of Section 10.28.030, any member of the police department authorized by the chief of police may remove such vehicle from the street in the manner and subject to the requirements of the Vehicle Code of the state.

No person shall park a vehicle upon a roadway for the principal purpose of:

A. Displaying such vehicle for sale;

B. Washing, greasing or repairing such vehicle except repairs necessitated by an emergency.

Except as otherwise provided in this chapter, parking on all streets in the city shall be parallel to the curb, whereby the right-hand wheels of any vehicle shall be within eighteen (18) inches of the curb, which parallel parking shall be that type of parking customarily used in the city wherein the vehicles are adjacent to one another.

Whenever any provision of this code or other ordinance of this city designates and describes any street or portion thereof upon which angle parking shall be permitted, the city engineer shall mark or sign such street indicating the angle at which vehicles shall be parked.

When signs or markings are in place indicating angle parking as provided by Section 10.28.070, no person shall park or stand a vehicle other than at the angle to the curb or edge of the roadway indicated by such signs or markings.

In accordance with Sections 10.28.070 and 10.28.080 and when signs or markings are in place giving notice thereof, drivers of vehicles may stand or park a vehicle only as indicated by such marks or signs on the following streets or portions thereof:

A. The city engineer is authorized to erect signs indicating no parking upon that side of any street adjacent to any school property when such parking would, in his opinion, interfere with traffic or create a hazardous situation.

B. When official signs are erected indicating no parking upon that side of a street adjacent to any school property, no person shall park a vehicle in any such designated place.

A. The city engineer is authorized to place signs or markings indicating no parking upon any street when the width of the roadway does not exceed twenty (20) feet, or upon one side of a street as indicated by such signs or markings when the width of the roadway does not exceed thirty (30) feet.

B. When official signs or markings prohibiting parking are erected upon narrow streets as authorized in this chapter, no person shall park a vehicle upon any such street in violation of any such sign or marking.

The city engineer shall appropriately sign or mark any place where he determines that it is necessary in order to eliminate dangerous traffic hazards and when so signed or marked no person shall stop, stand or park a vehicle in any of such places.

No person shall park or stand any vehicle or wagon used or intended to be used in the transportation of property for hire on any street while awaiting patronage for such vehicle or wagon without first obtaining a written permit to do so from the city council which shall designate the specific location where such vehicle may stand.

Whenever any permit is granted under the provisions of Sections 10.28.140 and 10.28.150 and a particular location to park or stand is specified therein, no person shall park or stand any vehicle, wagon or pushcart on any location other than as designated in such permit. In the event that the holder of any such permit is convicted in any court of competent jurisdiction for violating any of the provisions of this section, such permit shall be immediately revoked by the city council upon the filing of the record of such conviction with the city council. No permit shall thereafter be issued to such person until six (6) months have elapsed from the date of such revocation.

A. Whenever the chief of police shall determine than an emergency traffic congestion is likely to result from the holding of public or private assemblages, gatherings or functions, or for other reasons, the chief of police shall have power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing of vehicles is prohibited on such streets and alleys as the chief of police shall direct during the time such temporary signs are in place. Such signs shall remain in place only during the existence of such emergency and the chief of police shall cause such signs to be removed promptly thereafter.

B. When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, park or stand any vehicle contrary to the directions and provisions of such signs.

The city engineer is authorized, subject to the provisions and limitations of this chapter to place, and when required shall place, the following curb markings to indicate parking or standing regulations. Such curb markings have the following meanings:

A. Red means no stopping, standing, or parking at any time except as permitted by the state Vehicle Code; provided, that a bus may stop in a red zone marked or signed as a bus zone;

B. Yellow means no stopping, standing, or parking at any time between six a.m. and six p.m. of any day except Sundays and holidays for any purpose other than the loading or unloading of passengers or materials;

C. White means no stopping, standing, or parking for any purpose other than loading or unloading of passengers which shall not exceed three minutes and such restrictions shall apply between six a.m. and six p.m. of any day except Sundays and holidays and except as follows:

1. When such zone is in front of a hotel or church the restrictions shall apply at all times.

2. When such zone is in front of a theatre the restrictions shall apply at all times except when such theatre is closed;

D. Green means no standing or parking for longer than the period indicated by signs properly posted on any day except Sundays and holidays;

E. Blue means no standing or parking except for vehicles bearing a special license plate or special placard issued for disabled persons pursuant to Section 9105 or Section 22511.5 of the California Vehicle Code; provided, that there shall also be posted a sign as provided in Chapter 10.36. Blue curb parking spaces shall be operative twenty-four (24) hours a day, Sundays and holidays included.

No person shall stop, stand or park a vehicle adjacent to any such legible curb marking or sign in violation of any of the provisions of Section 10.28.180.

The city council shall, by ordinance or resolution, determine those streets, parts of streets, alleys or other locations, upon which parking shall be limited to stated periods of time, or to certain vehicles or shall be prohibited, and the city engineer shall designate such streets or parts of streets, alleys or other locations by appropriate signs, parking space markings or curb markings.

In accordance with Section 10.28.210, when signs are erected giving notice thereof, no person shall park a vehicle for a period of time longer than thirty (30) minutes between the hours of eight a.m. and five p.m. of any day except Saturdays, Sundays, and public holidays within a city parking lot or portion thereof as follows:

In accordance with Section 10.28.210, when signs are erected giving notice thereof, no person shall park a vehicle for a period of time longer than two (2) hours between the hours of eight a.m. and five p.m. of any day except Saturdays, Sundays and public holidays within a city parking lot or portion thereof as follows:

In accordance with Section 10.28.210, when signs are erected giving notice thereof, no person shall park a vehicle for a period of time longer than three (3) hours between the hours of nine a.m. and five p.m. of any day except Saturdays, Sundays and public holidays within a city parking lot or portion thereof as follows:

In accordance with Section 10.28.210, when signs are erected giving notice thereof, no person shall park a vehicle for a period of time longer than seventy-two (72) hours of any consecutive days except Saturdays, Sundays and public holidays within a city parking lot or portion thereof as follows:

In accordance with Section 10.28.210, where signs are erected giving notice thereof, no person shall park a vehicle for a period of time longer than ten (10) days within a city parking lot or portion thereof as follows:

When authorized signs are in place giving notice thereof, no person shall stop, stand or park any truck, trailer or semi-trailer along the following portions of the following streets:

When signs are erected in accordance with Section 10.28.210 to give notice thereof, no person, except in a recreational vehicle, shall park a vehicle in a city parking lot or portion thereof as follows:

When signs are erected in accordance with Section 10.28.210 to give notice thereof, no person shall stop, stand or park any vehicle at any time on any day between the hours of six p.m. and six a.m. along the following portions of the following streets:

A. Motorcycles—Generally. The city engineer shall designate parking spaces on-street and in public off-street parking which shall be reserved for motorcycles as defined in Section 400 of the California Vehicle Code. On-street parking for motorcycles shall be designated by sign or pavement marking. Off-street public parking stalls for motorcycles shall be designated by sign, pavement marking legend or motorcycle symbol.

It is unlawful for any person to park a vehicle other than a motorcycle in a parking stall designated and identified by appropriate sign, symbol or legend reserved for motorcycles only.

B. Motorcycles—Parking lots. When signs are erected or marking is in place in accordance with subsection A of this section to give notice thereof, no person shall park a vehicle other than a motorcycle in a city parking lot or portion thereof as follows:

C. Motorcycles—On-street parking. When authorized signs or markings are in place giving notice thereof, no person shall stop, stand or park a vehicle other than a motorcycle along the following portions of streets:

When the signs and parking space markings authorized by Section 10.28.230 are placed in the highway, subject to other and more restrictive limitations, no vehicle shall be stopped, left standing or parked, other than within a single space, unless the size or shape of such vehicle makes compliance impossible.

When authorized signs or curb markings are in place giving notice thereof, the locations described in the following paragraph are designated as large truck parking zones for Department of Motor Vehicle testing only during the time period of eight a.m. to five p.m., excepting Saturdays, Sundays and holidays.

When authorized signs or curb markings are in place on any street, alley or other public place, giving notice of time limitation on parking, it is unlawful for any person to stop, stand or park any vehicle in any such street, alley or public place for a period of time longer than indicated by such signs or curb markings. Such signs or curb markings may indicate the hours and days during which such time limitations are in force. If no other hours or days are indicated upon such signs or curb markings, the time limitations shall be in force between the hours of nine a.m. and five p.m. on any day except Sundays and holidays.

A. The city engineer is authorized to select and designate, and to install appropriate signs to identify certain parking stalls on streets or alleys and in public off-street parking lots, for use only by vehicles specifically authorized or permitted by the city. Any vehicle authorized or permitted to park in such designated and identified parking shall bear a distinctive insignia, seal, decal or other marking, identifying such vehicle as one so authorized or permitted.

B. It is unlawful for any person to park a vehicle, or to suffer or permit a vehicle of which he is the registered owner to be parked in any parking stall designated and identified by appropriate signs as reserved for official parking only, or, police vehicles only, or words of like or similar import, unless such vehicles bear a distinctive insignia, seal, decal or other marking issued by or approved by the city, identifying such vehicle as one authorized or permitted to park in such parking stall.

A. The city engineer shall designate spaces on-street and in public off-street parking which shall be reserved for disabled persons to whom has been issued a special license plate or special placard authorized by Section 9105 of 22511.5 of the California Vehicle Code.

B. On-street parking for disabled persons shall be designated by a blue curb as provided in Section 10.28.180 and, in addition to blue paint, the space may also be indicated by signs or other suitable means according to Vehicle Code Section 22511.7.

C. Off-street public parking stalls for disabled persons shall be designated in either of the following ways:

1. By posting immediately adjacent to, and visible from, each stall or space, a sign consisting of a profile view of a wheelchair with occupant in white on a blue background;

2. By outlining or painting the stall or space and outlining on the ground in the stall or space in white or suitable contrasting color a profile view of a wheelchair with occupant.

D. The posting required for an off-street parking facility owned or operated either privately or by a local authority shall consist of a sign not less than seventeen (17) by twenty-two (22) inches in size with lettering not less than one (1) inch in height which clearly and conspicuously states the following:

"Unauthorized vehicles not displaying distinguishing placards or license plates issued for physically handicapped persons will be towed away at owner's expense."

E. The sign shall be posted in either of the following locations:

1. Immediately adjacent to, or visible from, the stall or space;

2. In a conspicuous place at each entrance to the off-street parking facility.

When signs are erected in accordance with Section 10.28.270 of this chapter to give notice thereof, no person, except a disabled person who has been issued a special license plate or placard by the state, shall stop, stand, or park any vehicle along the following portion of the following street:

When signs are erected in accordance with Section 10.28.270 to give notice thereof, no person, except a disabled person who has been issued a special license plate or placard by the state, shall park a vehicle in a city parking lot or portion thereof as follows:

In accordance with Section 10.28.210, when signs are erected giving notice thereof, no person except in a city vehicle or in a vehicle bearing an authorized city placard shall stop, stand or park any vehicle in a city parking lot or portion thereof between the hours of eight a.m. and five p.m. of any day except Saturdays, Sundays and public holidays within a city parking lot or portion thereof as follows:

No person shall park or leave standing any commercial vehicle, as defined in the Vehicle Code of the state, upon any street within any residential district of the city, if such vehicle has a manufacturer's gross vehicle weight rating of ten thousand pounds or more, for any purpose other than making pickups or deliveries of persons, goods, wares, and merchandise from or to any building or structure, located on such street or for any purpose other than delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure upon such street for which a building permit has previously been obtained. A residential district of the city is any area of the city which is classified as residential under the provisions of Title 18.

A. A person shall not park any trailer or semitrailer upon Wardrobe Avenue unless the trailer or semitrailer is at all times while so parked attached to a vehicle capable of moving the trailer or semitrailer in a normal manner upon the highway, street, alley, public way or public place.

B. This section shall not apply to trailers or semitrailers in the process of being loaded or unloaded, nor shall it apply to any trailer or semitrailer which is disabled in such a manner and to such an extent that it is impossible to avoid stopping and temporarily leaving the disabled trailer or semitrailer on that portion of the highway, street, alley, public way or public place ordinarily used for vehicular parking.

No person shall park any truck, trailer or semitrailer between the hours of three-thirty a.m. and five-thirty a.m. along the following portions of the following streets:

The city council shall, by ordinance or resolution, determine those streets at which vehicles traveling on intersecting streets shall be brought to a full stop before entering such intersection, and the city engineer shall designate such streets and intersections by appropriate signs or markings.

The driver of any vehicle upon approaching the entrances of any of the following intersections signposted with a stop sign shall stop:

A. At a limit line if marked, otherwise, before entering the crosswalk on the near side of the intersection, or, if not marked, then before entering the intersection; or

B. At any point within the intersection as required by a stop sign; and after such stop the driver shall yield the right-of-way to other vehicles on that part of any street protected by any stop sign which are so close as to constitute an immediate hazard and shall continue to yield the right-of-way to such approaching vehicles until such time as he can proceed with reasonable safety. A. 24. Glen Avenue: From the north line of Yosemite Park Way to the south line of South East Bear Creek Drive, except at its intersection with Santa Fe Avenue;

25. West Main Street: From the east line of V Street to the west line of G Street;

26. East Main Street: From the east line of G Street to the north line of Yosemite Park Way (California Route, Highway 140);

27. McKee Road: From the northerly city limits, except at its intersection with Olive Avenue;

28. McSwain Road (California Route, Highway 140): From the west city limits to the west line of V Street;

29. East Olive Avenue: From the easterly city limits, except at its intersection with McKee Road;

48. Carmen Way: From G Street to Las Brisas Street;

The driver of any vehicle upon approaching the entrances of any of the following alley intersections signposted with a stop sign shall stop:

A. At a limit line, if marked, otherwise before entering the crosswalk on the near side of the intersection, or, if not marked, then before entering the intersection; or

B. At any point within the intersection as required by a stop sign; and after such stop the driver shall yield the right-of-way to other vehicles on that part of any street protected by any stop sign which are so close as to constitute an immediate hazard and shall continue to yield the right-of-way to such approaching vehicles until such time as he can proceed with reasonable safety. A driver, having yielded, may proceed and the drivers of all other vehicles approaching on that part of the street protected by the stop sign shall yield the right-of-way to the vehicle about to enter or cross the protected part of the street:

A. The driver of any vehicle upon approaching the entrance of any of the following intersections signposted with a yield sign shall not enter such intersection at a speed exceeding fifteen (15) miles per hour, and shall slow down and stop if necessary and yield the right-of-way to other vehicles which have entered the intersection from an intersecting street or which are approaching so closely on the intersecting street as to constitute an immediate hazard and shall continue to yield the right-of-way to such approaching vehicles until such time as he can proceed with reasonable safety.

B. A driver, having so yielded, may then proceed and the drivers of all other vehicles approaching the intersection on the intersecting street shall yield the right-of-way to him:

1. Eastbound traffic on West Olive Avenue yields to southbound traffic on G Street on the southwest corner of the intersection;

2. Northbound traffic on G Street yields to eastbound traffic on East North Bear Creek Drive at the southwest corner of the intersection;

3. Southbound traffic on G Street yields to westbound traffic on West North Bear Creek Drive at the northwest corner of the intersection;

4. Q Street yields to traffic on West 25th Street;

5. On Childs Avenue eastbound traffic turning north onto B Street yields to westbound traffic turning north on B Street;

6. On East 27th Street, eastbound and westbound traffic yield to southbound and northbound traffic on 4th Avenue;

7. H Street yields to traffic on West 22nd Street;

8. On Quail Avenue, northbound and south-bound traffic yield to eastbound and westbound traffic on Mallard Drive;

9. On 21st Street, eastbound and westbound traffic yield to southbound and northbound traffic on "T" Street.

A. Leased parking spaces shall be located in city lots, parking authority lots, the Shannon Parcade and the Merced Center Garage in a manner that will promote the public good and enhance customer access to downtown businesses. The number and location of such spaces shall be designated by the Director of Economic Development of the City of Merced for city-owned parking lots (including the Shannon Parcade) and the executive director of the parking authority or his/her designee for parking authority owned parking lots (including the Merced Center Garage). Any parking space in any city lot, parking authority lot, the Shannon Parcade or the Merced Center Garage described in this section shall become a leased parking space when signed or marked to indicate its reserved status. The provisions of this section shall supersede any other designation in this chapter except those spaces provided for the disabled. In the event a parking space is released from the lease program by the director of economic development or the executive director of the parking authority, it shall revert to its current designation in this chapter.

1. When a space is signed or marked indicating that it is a leased space, no person, except the person who has been issued a lease permit by the city or parking authority, shall park a vehicle in the spaces so designated as follows:

B. Persons desiring to lease reserved parking spaces shall apply to the city finance department for a permit and pay the first quarter lease amount in advance. The cost of a lease permit shall be set by resolution of the city council. No refund will be issued for any unused portion for the quarter or in the event parking is unavailable due to special events or maintenance shutdowns. The permit shall be transferable. Permits to lease such spaces shall entitle the possessor of such permit to use any reserved space in the lot number designated on the permit from the hours of seven a.m. through six p.m. Monday—Friday. The permit shall be displayed in the vehicle by attaching it to the rear view mirror of the vehicle as directed.

C. Any person parking in a reserved space which has been signed or marked shall be guilty of an infraction and shall pay a fine as set by resolution of the city council.

In accordance with Section 10.28.210, when signs are erected giving notice of "customer parking only," no business owner, employee, or student shall park within the customer parking area while working at a place of business or attending school, or cause, allow, suffer or permit any motor vehicle owned, operated or controlled by any of them to be so parked between the hours of nine a.m. and four p.m. of any day except Saturdays, Sundays, and state holidays.

Every business owner or public educational institution whose business or classroom is located within the customer parking area shall furnish the finance officer with the following information:

A. By no later than August 1, 1994, and then annually by January 1 of each year, the full name of all such owners, employees and students working or attending class within the customer parking area, and the license number of every vehicle owned, operated or controlled by any of them.

B. Any change to the information provided in subsection A above within ten (10) calendar days of such change.

C. The information required by this section shall be supplied in a manner and on forms prescribed by the finance officer or his/her designee.

D. No person who receives or has knowledge or possession of information required by this section may divulge in any manner such information to any person not associated with the administration or enforcement of this section and Section 10.28.430.

For purposes of Sections 10.28.430 and 10.28.440, the following definitions shall apply:

A. "Business" refers to a commercial, professional service enterprise, or public or private educational institution.

B. "Customer parking area" is that area within the city of Merced described as follows:

Commencing at a point that is the intersection of the centerline of West 18th Street and the centerline of Martin Luther King, Jr. Way, said point being the true point of beginning;

1. Thence southwesterly along the centerline of Martin Luther King, Jr. Way to a point on the centerline of West 16th Street;

2. Thence northwesterly along said centerline of West 16th Street to a point on the centerline of N Street;

3. Thence northeasterly along said centerline of N Street to its intersection with the centerline of the alley between West 18th Street and West 19th Street;

4. Thence southeasterly along the centerline of said alley to a point in the centerline of Martin Luther King, Jr. Way;

5. Thence southwesterly along said centerline of Martin Luther King, Jr. Way to its intersection with the centerline of West 18th Street said point being the point of commencement.

C. "Employee" means any person who is working for a business, whether paid or unpaid.

D. "Student" means any person who is scheduled to attend a class held by a public educational institution for fifteen (15) or more hours per week.

Notwithstanding any other provision of this chapter, any person upon conviction of each violation of Section 10.28.430 or 10.28.440 shall pay a fine as set by resolution of the city council.
