5.40.010 - Definitions.

For the purposes of this chapter, the following words have the meanings set out in this section:

"Pawnbroker" means a person engaged in the business of receiving goods in pledge as security for a loan.

"Pawnshop" means any room, store or place in which any such business is engaged in, carried on or conducted.

"Secondhand dealer" means a person engaged in conducting, managing or carrying on the business of buying, selling or otherwise dealing in secondhand goods, wares or merchandise, including radios for use in or upon automobiles, household furniture and furnishings, and any other items of personal property.

5.40.020 - Daily reports of property received or purchased.

Every pawnbroker and secondhand dealer shall prepare daily reports in the manner prescribed by state law. Where state law requires pawnbrokers to prepare such daily reports, this section requires the same reports to be prepared by secondhand dealers.

5.40.030 - Copies of reports at place of business.

Where required by state law, copies of all reports required by this chapter shall be maintained at the place of business.

5.40.040 - Reports to be made concurrent with transactions.

Where required by state law, all reports required by this chapter shall be prepared in a clear and legible manner, and at the time the transaction is made.

5.40.050 - Filing and exhibition of reports.

Where required by state law, all reports required by this chapter shall be filed in the manner prescribed by law. Reports prepared by secondhand dealers shall be submitted to the city clerk on the first Monday of each month.

5.40.060 - Thirty-day holding period.

All goods, wares, merchandise and other personal property purchased or received by any pawnbroker or secondhand dealer shall be held for a period of at least thirty (30) days after purchase or receipt before the same shall be sold or otherwise disposed of; excepting, however, all goods, wares, merchandise and other personal property upon which any duly licensed pawnbroker has issued a pawn ticket in accordance with the laws of the state of California, and during said thirty-day period all such property shall be kept separate and apart from all other goods, wares, merchandise and other personal property upon the premises and in the possession of such pawnbroker or secondhand dealer, and all such property shall during said thirty-day period be kept and exposed for police inspection during business hours.
