5.08.010 - Business license fees.

A. Business license fees shall be paid as provided in this chapter.

B. Businesses which qualify under more than one classification shall pay the highest license fee applicable to such business.

C. Where more than one business is conducted from a single location and such businesses are operated by or under separate owners, a license fee shall be paid by each separately owned business.

D. Persons conducting business at two or more separate branches or locations shall pay a license fee for each branch or location.

5.08.020 - Amusement centers.

Persons engaged in the business of operating a pool or billiard parlor or a video arcade containing one or more video game machines shall pay a license fee of twenty-five dollars ($25.00) for each pool/billiard table and video game machine per year.

5.08.030 - Amusement park rides and attractions.

Persons engaged in the business of operating or conducting an amusement park ride or attraction, including amusement park rides or attractions which are part of a carnival show, shall pay a license fee of ten dollars ($10.00) per day for each ride or attraction for which a separate admission is charged.

5.08.040 - Apartments.

Persons engaged in the business of conducting or operating a multiple unit rental dwelling shall pay a license fee according to the following schedule: Less than ten units—one hundred dollars ($100.00) per year; ten units or more—two hundred dollars ($200.00) per year.

5.08.050 - Astrologers, clairvoyants, palm readers and others.

Astrologers, seers, fortune tellers, hypnotists, clairvoyants, spiritualists, spiritualistic mediums and phrenologists who demand a fee for their services shall pay a license fee of ten dollars ($10.00) per day.

Persons conducting an auction shall pay a license fee of two hundred dollars ($200.00) per year.

5.08.070 - Automobile dealers.

Persons engaged in the business of selling or dealing in new or used automobiles shall pay a license fee of two hundred dollars ($200.00) per year.

5.08.080 - Bakeries and bakery products.

Persons engaged in the business of keeping or carrying on a bakery, or selling or distributing breads, pastries or other bakery products shall pay a license fee of one hundred fifty dollars ($150.00) per year.

5.08.090 - Barber and beauty shops.

Persons engaged in the business of conducting or operating a barber shop and/or beauty shop shall pay a license fee of one hundred fifty dollars ($150.00) per year.

5.08.100 - Bars or cocktail lounges.

Persons engaged in the business of operating a bar or cocktail lounge shall pay a license fee of five hundred dollars ($500.00) per year.

5.08.120 - Circus, menagerie and others.

Persons engaged in the business of conducting or exhibiting a circus, caravan, menagerie, collection of animals or acrobatic performance shall pay a license fee of twenty-five dollars ($25.00) per day. Where separate admissions are charged by a collection of businesses under separate ownerships, each business shall pay a separate license fee.

5.08.130 - Commercial miscellaneous.

Persons engaged in a commercial business not otherwise classified in this chapter shall pay a license fee of one hundred fifty dollars ($150.00) per year.

5.08.135 - Social facilities.

Persons engaged in the operation of a social facility as defined in Chapter 17.82 of this code shall pay an annual license fee dependent upon the type of operation as follows:

  1. For social facilities operating as a standalone business—Two hundred fifty dollars ($250.00) per year for each such hall.

  2. For social facilities operating in conjunction with another authorized business that is also subject to the provisions of this chapter—One hundred fifty dollars ($150.00) per year for each such hall.

5.08.140 - Contractors.

Persons engaged in the business of contracting (i.e., building, painting, plumbing, mechanical, electrical, etc.) and having at least ten employees shall pay a license fee of fifty dollars ($50.00) per month. Contractors with fewer than ten employees shall pay a license fee of twenty-five dollars ($25.00) per month.

5.08.150 - Cotton gins.

Persons engaged in the business of operating or conducting a cotton gin shall pay a license fee of five hundred dollars ($500.00) per year.

5.08.160 - Food markets.

Persons engaged in the business of operating a food market with less than one thousand five hundred (1,500) square feet of retail floor space shall pay a license classification fee of one hundred fifty dollars ($150.00) per year. Food markets with one thousand five hundred (1,500) square feet or more of retail floor space shall pay a license fee of four hundred dollars ($400.00) per year.

5.08.170 - Garages and machine shops.

Persons engaged in the business of conducting or operating a machine shop or garage for the storage of or repair of automobiles, trucks or other motor vehicles shall pay a license fee of one hundred fifty dollars ($150.00) per year.

5.08.180 - Gasoline and petroleum products.

Persons engaged in the business of distributing, delivering, soliciting or obtaining orders for the distribution or delivering of oil, coal oil, gasoline, grease or other petroleum products from vehicles, cans, drums or tanks shall pay a license fee of five hundred dollars ($500.00) per year. Persons in the business of delivering or distributing lubricating oil and no other petroleum products shall pay a license fee of one hundred fifty dollars ($150.00) per year. Persons engaged in the business of operating a gasoline and/or service station shall pay a license fee of one hundred fifty dollars ($150.00) per year.

5.08.185 - Home occupations.

Persons operating a home occupation pursuant to a duly approved home occupation permit shall pay a license fee equal to the fee normally required of that occupation, or the most similar occupation thereto, as indicated in this chapter.

5.08.190 - Hotels and motels.

Persons engaged in the business of conducting or operating a hotel or motel shall pay a license fee of one hundred fifty dollars ($150.00) per year. For hotels and motels with ten or more units, the license fee is three hundred dollars ($300.00) per year.

5.08.200 - Ice cream and snow-cone trucks.

Persons engaged in the business of operating an ice cream or snow-cone truck shall pay a license fee of one hundred fifty dollars ($150.00) per year.

5.08.210 - Ice manufacturing and distribution.

Persons engaged in the business of supplying, manufacturing or distributing ice shall pay a license fee of one hundred fifty dollars ($150.00) per year.

5.08.220 - Industrial miscellaneous.

Persons engaged in an industrial or manufacturing business shall pay a license fee of five hundred dollars ($500.00) per year.

5.08.230 - Motorized itinerant vendor.

Persons engaged in business as a motorized itinerant vendor shall pay an annual license fee in the amount set by resolution of the city council for each place of business.

5.08.240 - Job printing.

Persons engaged in the business of printing shall pay a license fee of one hundred fifty dollars ($150.00) per year.

5.08.250 - Junk or second-hand merchandise.

Persons engaged in the business of purchasing, selling or storing junk or second-hand merchandise shall pay a license fee of two hundred dollars ($200.00) per year.

5.08.260 - Laundries.

Persons engaged in the business of conducting or operating a laundry or wash house, dry cleaning and/or pressing service, or soliciting for such business shall pay a license fee of one hundred fifty dollars ($150.00) per year. Soliciting for washing, laundry, dry cleaning or pressing service to be performed outside the city shall not constitute an exemption from the fee.

5.08.266 - Lessors of residential real property.

Property owners engaged in the business of providing rental residential dwellings, excepting owner-occupied rental residential dwellings therefrom, shall pay an annual license fee in the following amounts:

A. One hundred eighty-eight dollars ($188.00) for the first rental residential dwelling per year; and

B. Fifty-two dollars ($52.00) for the second and each additional rental residential dwelling per year.

5.08.270 - Liquor stores.

Persons engaged in the business of the retail sale of alcoholic beverages shall pay a license fee of two hundred dollars ($200.00) per year.

5.08.280 - Lodging houses, boarding houses or labor camps.

Persons engaged in the business of conducting or operating a lodging house, boarding house or labor camp shall pay a license fee of one hundred fifty dollars ($150.00) per year. For lodging houses, boarding houses and labor camps with ten or more units, the license fee is three hundred dollars ($300.00) per year.

5.08.290 - Money lenders and savings and loan associations.

Persons engaged in the business of conducting or operating a lending institution or savings and loan establishment shall pay a license classification fee of one hundred fifty dollars ($150.00) per year.

5.08.300 - Musical and theatrical shows.

Persons engaged in the business of presenting or promoting a musical or theatrical show on city-owned property and for which an admission charge is collected shall pay a license fee of five hundred dollars ($500.00) for each day that the show is performed for an admission charge.

5.08.310 - Outdoor advertising.

Persons engaged in the business of bill posting or maintaining a billboard or structure for the posting of bill(s) or other outdoor advertisement(s) shall pay a license fee of five hundred dollars ($500.00) per year.

5.08.320 - Packing sheds.

Persons engaged in the business of conducting or operating a building or shed for the purpose of packing, washing or sorting vegetables, fruit or other produce shall pay a license fee of one thousand dollars ($1,000.00) per year.

5.08.330 - Pawnbrokers.

Persons engaged in the business of conducting or carrying on a pawn shop or acting as a pawnbroker shall pay a license fee of two hundred dollars ($200.00) per year.

5.08.340 - Sidewalk vendor.

Persons engaged in business as a sidewalk vendor shall pay an annual license fee in the amount set by resolution of the city council for each place of business.

5.08.350 - Professionals.

Persons engaged in, or carrying on, or conducting a profession shall pay a license fee of three hundred dollars ($300.00) per year for each person engaged in the profession in Mendota. "Profession" means a calling requiring specialized knowledge, training or academic preparation or certification, and shall include, but not be limited to:

  1. Accountants;

  2. Attorneys;

  3. Bookkeepers;

  4. Chiropodists;

  5. Chiropractors;

  6. Civil engineers;

  7. Consultants;

  8. Computer programmers;

  9. Counselors;

  10. Dentists;

  11. Dental hygienists;

  12. Electrical engineers;

  13. Grain buyers;

  14. Insurance adjusters;

  15. Insurance brokers;

  16. Landscape architects;

  17. Metallurgists;

  18. Morticians;

  19. Opticians;

  20. Osteopaths;

  21. Pharmacists;

  22. Physical therapists;

  23. Physicians;

  24. Psychiatrists;

  25. Psychologists;

  26. Real estate licensees;

  27. Surveyors;

  28. Veterinarians; and

  29. X-ray technicians.

5.08.355 - Recycling facilities.

Persons engaged in the operation of recycling facilities shall pay an annual license fee dependent upon the classification of such facility as follows:

  1. Reverse vending machine—Fifty dollars ($50.00) per year for each such machine.

  2. Collection facility, small—Seventy-five dollars ($75.00) per year for each such facility.

  3. Collection facility, large—One hundred fifty dollars ($150.00) for each such facility.

  4. Light processing facility—Two hundred fifty dollars ($250.00) per year for each such facility.

  5. Heavy processing facility—Five hundred dollars ($500.00) per year for each such facility.

For the purposes of determining the classification of a particular facility, the definitions contained in Section 17.04.110(C) shall apply.

5.08.360 - Restaurants and lunch counters.

Persons engaged in the business of operating a restaurant or lunch counter shall pay a license fee of one hundred fifty dollars ($150.00) per year for each place of business.

5.08.370 - Security companies.

Persons engaged in the business of operating a security company or providing security services in the city shall pay a license fee of two hundred dollars ($200.00) per year.

5.08.380 - Shoe shine and shoe repair shops.

Persons engaged in the business of conducting or operating a boot-black, shoe shine parlor or shoe repair shop shall pay a license fee of one hundred fifty dollars ($150.00) per year.

5.08.390 - Side shows, temporary exhibits, magicians.

Persons engaged in the business of conducting or exhibiting a side show, temporary exhibit or magic show shall pay a license fee of twenty-five dollars ($25.00) per day. Where separate admissions are charged by a collection of such businesses, each separate admission shall be deemed a separate business.

5.08.400 - Skating rinks, bowling alleys and dance halls.

Persons engaged in the business of operating or conducting a bowling alley, skating rink or dance hall shall pay a license fee of two hundred dollars ($200.00) per year.

5.08.410 - Soda water, soft drinks, dairy products and other wholesale sales.

Persons engaged in the business of manufacturing, delivering, selling, distributing or soliciting orders for the wholesale sale of soda pop, dairy products, mineral water or other nonalcoholic beverages shall pay a license fee of three hundred dollars ($300.00) per year.

5.08.420 - Disk jockeys and purveyors of amplified music.

Persons engaged in the business of conducting or providing amplified music, particularly disk jockeys, shall pay an annual business license fee of three hundred dollars ($300.00) and shall obtain an amplified music permit for any engagement, paid or unpaid, to be conducted within the city of Mendota. Should the purveyor of amplified music fail to comply with the tenants of any section of the Mendota Municipal Code, the city manager, or their designee, shall have the authority to revoke said business license without refund to the purveyor.

5.08.430 - Telephone companies and exchanges.

Persons engaged in the business of operating or conducting a telephone exchange or telephone company shall pay a license fee of one thousand dollars ($1,000.00) per year.

5.08.440 - Theaters.

Persons engaged in the business of conducting or operating a theater or show room featuring motion pictures shall pay a license fee of one hundred fifty dollars ($150.00) per year. Theaters and show rooms featuring live performances shall pay a license fee of three hundred dollars ($300.00) per year. Theaters and show rooms featuring adult live performances shall pay a license fee of five hundred dollars ($500.00) per year. "Adult live performances" means shows in which the performer(s) disrobes, partially disrobes or exhibits his/her genitalia, behind or breast(s). (The exhibition of breasts applies only to female performers.)

5.08.450 - Towing and dismantling services.

Persons engaged in the business of towing and/or dismantling motor vehicles shall pay a license fee of one hundred fifty dollars ($150.00) per year.

5.08.470 - Wholesaling (miscellaneous).

Persons engaged in the business of distributing or selling at wholesale or soliciting orders for any goods, wares or merchandise not otherwise covered by this chapter shall pay a license fee of three hundred dollars ($300.00) per year.
