8.32.010 - Insects—Violation.

It is unlawful and is declared a public nuisance for any person owning, leasing, occupying, or having charge or possession of any property in the city to permit or maintain such property which results in the breeding, nesting and growth of Cinch Bugs, False Cinch Bugs, or any other insect that migrates therefrom to adjacent or surrounding properties in numbers that is injurious to health, or is indecent or offensive to the senses, or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property.

8.32.020 - Abatement by eradication or removal.

A. All or any part of any property found, as provided in this chapter, to constitute a public nuisance may be abated by eradication and a lien established for the costs thereof pursuant to the procedures set forth in Chapter 8.24 of this code, commencing with Section 8.24.030, all of which are incorporated herein by this reference, provided, however, the council shall have the authority to:

  1. Modify the applicable wordings of any notices described therein to conform to the intent of this chapter; and

  2. In the event of the immediate need of eradication, the council shall have the authority to shorten the periods of time of each notice to be given to the applicable parties therein and/or any other action to be taken by the city provided such time periods will give the applicable parties notice thereof at least forty-eight hours prior to the commencement of any eradication.

B. The procedures set forth in Chapter 8.24 shall not be exclusive, and shall not in any manner limit or restrict the city from enforcing other city ordinances or abating public nuisances in any other manner provided by law nor to prevent the city from commencing civil or criminal proceedings for the violation of this chapter.

8.32.030 - Violations.

A. The owner or other person having charge or control of any such property who maintains any public nuisance defined in this chapter, or who violates an order of abatement made pursuant to this chapter, is guilty of an infraction.

B. Any person who removes any notice or order posted as herein required for the purpose of interfering with the enforcement of these provisions shall be guilty of an infraction.

C. Any person who obstructs, impedes or interferes with any representative of the city council or any representative of a city department with the enforcement of the provisions of this chapter shall be guilty of an infraction.
