4-3.101 - Permits—Required—Exceptions.

(a) It is unlawful for any person stop, stand, or park any motor vehicle between the hours of 2:00 a.m. and 6:00 a.m. of any day on any street so designated by resolution of the Council, which resolution shall be published in accordance with State law not later than fifteen (15) days after the adoption thereof, unless such person shall have obtained an all-night parking permit as provided in this article. No such permit shall be issued so as to permit the parking of any vehicle which is in excess of ninety (90) inches in width or which 6,000 pounds or more in gross weight.

(b) The provisions of this article shall not apply to emergency vehicles, hybrid vehicles displaying a California DMV issued Clean Air Vehicle Sticker, or to two-wheeled vehicles such as motorcycles and motor scooters which are parked in such a manner as to not interfere with automobile parking.

(c) Persons entitled to issuance of permits shall be any person whose drivers license, DMV change of address certificate, or current vehicle registration, shows the address in question as the registered address. In addition, any person who lacks a drivers license or whose drivers license or vehicle registration shows a different address, shall be entitled to issuance of a permit if he or she presents a recent gas or electrical bill in his or her name showing service at, and bills mailed to, the subject address, and executes a sworn declaration under penalty of perjury stating that the subject address is his or her permanent residential address.

4-3.102 - Permits: Applications.

Every person desiring an all-night parking permit shall file with the City Clerk, or his designated representative, a written application therefor on a form furnished by the City. Each application shall set forth:

(a) The name and residence address of the applicant;

(b) The license number and the make and model of the vehicle for which such permit is requested;

(c) A statement of facts demonstrating the necessity for the requested permit, specifically including the facts showing that no parking space is available or obtainable upon the property designated as the applicant's residence;

(d) The period of time for which such permit is requested;

(e) Such additional information as the City, through its representatives, may require in order to carry out the purposes of this article;

(f) A statement that the applicant declares under penalty of perjury that all the statements in the application are true; and

(g) The signature of the applicant.

4-3.103 - Permits: Investigations.

Upon the filing of an application for an all-night parking permit, the City Clerk shall cause to be made such investigation thereof as he may deem necessary and practical to determine whether or nor there is sufficient justification for the requested permit. If it shall appear that there is not adequate or proper off-street parking space obtainable by the applicant at the place of his residence for the parking of the vehicle described in the application, an all-night parking permit shall be granted for parking on the public streets, subject, however, to posted restrictions relating to no parking and/or limited parking during specified periods of time.

4-3.105 - Permits—Expiration date.

Each permit issued pursuant to the provisions of this article shall expire at midnight on August 31 following the date of issuance.

4-3.106 - Permits—Fees.

Each application for an all-night parking permit shall be accompanied by an investigation fee of Five and No/100ths ($5.00) Dollars and a permit fee based upon an annual fee of Twenty and No/100ths ($20.00) Dollars. The amount to be paid for the permit fee shall be prorated on a quarterly basis if issued for less than one (1) year. When issued, the permit fee shall entitle the permittee to park one (1) vehicle for the balance of the year, to and including August 31. Where the necessity for the permit continues, such permit may be renewed upon the payment of a fee of Twenty and No/100ths ($20.00) Dollars for each additional year, or portion thereof, for which the permit is issued, prorated on a quarterly basis.

4-3.107 - Permits—Fees—Refunds.

If, after investigation, an all-night parking permit is not granted, the permit fee tendered with the application shall be refunded, but no part of the investigation fee shall be refunded. After the issuance of an all-night parking permit, or upon the revocation thereof, no portion of the permit fee shall be refunded.

4-3.108 - Permits—Denial—Notices.

If the application for an all-night parking permit shall be denied by the City Clerk, a notice of denial shall be mailed to the applicant, together with the amount of the permit fee to be refunded.

4-3.109 - Permits—Denial—Appeals.

The applicant may, within ten (10) days following the receipt of such notice, file a written appeal from the denial with the City Clerk, and the appeal shall be referred to the Council at its next meeting. A fee equal to the amount refunded shall accompany such appeal.

4-3.110 - Permits—Revocation.

If an investigation by the City shall disclose, or upon receipt of information from any source, that any material information in the application was or is no longer true or valid, the City Clerk shall order such permittee to show cause why such permit should not be revoked. Such order shall be sent by regular mail, postage prepaid, to the permittee's address at least five (5) days prior to the date upon which such permittee is ordered to appear. If, from the evidence at hand, the City Clerk determines material information in the application was or is no longer true or valid, or conditions are such that an original permit would not be issued, he shall revoke the permit issued to the permittee and give the permittee notice thereof by regular mail addressed to the place shown in the person's application as his residence.

Any person who displays, or permits to be displayed, the decalcomania or emblem issued by the City for all-night parking after the same has been revoked, as set forth in this section shall be guilty of a misdemeanor.

4-3.111 - Temporary permits.

The City Clerk or his or her designated representative, for good cause may, upon an oral or written application, grant temporary permission for the parking of a vehicle for a period of time not to exceed fifteen (15) days. No fee shall be due or payable for any such permit, and the decision of the City Clerk or his or her designated representative shall be final in each such case. Not more than two (2) temporary permits shall be issued to a vehicle at any address within any one (1) year period.

4-3.112 - Emblems—Issuance.

A decalcomania or other appropriate emblem in the form approved by the City Clerk shall be issued with each permit for use as specified in Section 4-3.112 of this article.

4-3.113 - Emblems—Display.

No all-night parking permit issued pursuant to the provisions of this article shall be effective at any time until the decalcomania or emblem issued by the City with such permit is affixed to the driver's side door window of such vehicle.

4-3.114 - Change of address of permittees.

If the permittee shall change his address, he shall notify the City Clerk who shall cause an appropriate investigation to be made to determine if the permit shall be transferred to the new location to continue in effect the remaining portion of the existing permit.

4-3.115 - Parking on specified streets.

A permit for all-night parking shall not entitle the permittee to stop, stand, or park his vehicle in violation of any parking limitations or restrictions which may be imposed by ordinance or resolution which specifically excludes parking by all-night parking permits.
