10-2.01 - Permits required.

No person shall plant, remove, destroy, cut, prune, deface, or in any manner injure any tree or shrub on any street in the City without first obtaining a permit to do so from the Street Superintendent.

10-2.02 - Permit to remove or destroy: Conditions.

As a condition to any permit to remove or destroy any tree, the Street Superintendent may require that the permittee plant another tree in place of the one to be destroyed or removed. Whenever any such tree has been destroyed or removed pursuant to any such conditional permit, it shall be a misdemeanor for the permittee to fail, refuse, or neglect to plant another tree of the type and size specified in the permit in place of the one destroyed or removed within forty (40) days from the date of the issuance of the permit.

10-2.03 - Permit to remove or destroy: Fees.

A fee in the amount of One and no/100ths ($1.00) Dollar shall be charged for each permit issued by the Street Superintendent for the removal or cutting down of any tree or shrub on any street in the City. Such permit fee shall include the permit for the removal or cutting down of any number of trees or shrubs up to and including ten (10) of either such trees or shrubs. If a permit shall be issued for the removal or cutting down of more than ten (10) trees, an additional charge in the amount of fifty ($0.50) cents shall be charged for every additional unit of ten (10) trees or shrubs, or fraction thereof. Such permits shall specifically describe the work to be done thereunder and shall be void after thirty (30) days from the date of issuance. Such fees shall be turned over to the City as a departmental receipt.

No fee shall be charged for any permit to plant any tree, shrub, or plant.

10-2.04 - Stakes and guards.

Tree stakes or guards may be placed around trees, shrubs, or plants by the property owners provided such stakes or guards are merely placed near the trees, shrubs, or plants for the purpose of protecting or training such trees, shrubs, or plants.

10-2.05 - Injuring.

No person shall pile building materials or other materials around any tree, plant, or shrub on a street in any manner which would in any way injure such tree, plant, or shrub.
