Chapter 18.62 — OUTDOOR SALES

§ 18.62.010. Outdoor sales—Prohibited. ¶
Except as specifically set forth in Section 18.62.020 , no sale, display or storage of merchandise shall be permitted within any commercial district outside of a completely enclosed building or area enclosed by a six-foot-high fence or wall obstructing view from adjacent streets and adjacent property, unless a use permit is obtained in accordance with Chapter 18.72 . § 18.62.020. Exceptions. ¶
The prohibitions set forth in Section 18.62.010 shall not apply to the following uses:
(a) Uses based in a permanent building including service stations, nurseries, new and used vehicle sales and rental lots, lumber yards or industrial operations;
(b) Temporary or special event sidewalk or parking lot sales carried on by and adjacent to an existing commercial business conducted within a building;
(c) The seasonal sales of Christmas trees, fireworks, fresh fruits or fresh vegetables; provided, that such use shall not interfere with normal traffic flow or parking on or adjacent to the subject parcel;
(d) One-day fundraising sales or promotional events conducted on a specific site by a nonprofit organization;
(e) Uses controlled by Section 10.44.130 ;
(f) The display or sale of newspapers, magazines and other periodicals customarily sold by news vendors on the sidewalk from vending racks or machines provided for the display or sale does not interfere with normal pedestrian traffic;
(g) The delivery of goods or merchandise upon order of or by agreement with a customer from a store or other fixed place of business or distribution. Any goods or merchandise necessarily delivered to a street, public parking lot or sidewalk shall be removed therefrom within thirty minutes after said delivery;
(h) Special events sponsored by an association of merchants;
(i) Any lawful outdoor sales use existing on the effective date of the ordinance codified in this chapter, as determined by the planning director.

§ 18.62.030. Penalty. ¶
Any person who violates this chapter shall be guilty of an infraction, punishable by:
(a) A fine, not exceeding one hundred dollars, for the first violation;
(b) A fine, not exceeding two hundred dollars, for a second violation of this chapter within one year;
(c) A fine, not exceeding five hundred dollars, for each additional violation of this chapter within one year.
