12.32.010 Statement Of Purpose

The board of supervisors of the county of Mariposa makes the following findings regarding the necessity for the regulation of skateboards, rollerskates, in-line skates, rollerskis and similar devices, hereinafter referred to as “skateboards.”

For the purpose of this chapter, the following words and phrases shall have the meaning given herein:

  1. “Parking lot” means areas that are used primarily for the parking of motor vehicles.

  2. “Private property” means all property located within the area defined herein which is neither owned nor controlled by a governmental entity.

  3. “Public property” means all property within the area defined herein which is either owned or controlled by a governmental entity, including but not limited to, sidewalks, highways, streets and parking lots.

  4. “Sidewalk” means that portion of a road, street, or highway designed or ordinarily used for pedestrian travel and includes any pedestrian walkways in the area defined herein.

  5. “Skateboard, rollerskates, in-line skates and rollerskis” means any board footwear, or any other object or device which has wheels attached to it by any means whatsoever and which is propelled by pushing, pulling or gravitational forces and to which there is not affixed any mechanism or device for steering.

  6. “Street, public street” means that portion of any highway or street improved or designed especially for vehicular use or travel.

It is unlawful for any person to use or operate a skateboard on any public property, including but not limited to, sidewalks, highways, streets and parking lots, located in the unincorporated area known as “town of Mariposa” from: 1) the location of the east side of Mariposa Creek to the east side of Bullion Street and from the north side of 7th Street including sidewalks to the south side of 4th Street including sidewalks and all of the area encompassed therein; 2) the location of the west edge of Jones Street abutting the government center parking lot to the corner of 9th Street abutting the county courthouse to the corner of 9th Street and Bullion Street; the east edge of Bullion Street abutting the county courthouse to the north edge of 11th Street; all of 11th Street and all of the county government center parking lot; including sidewalks and all of the area encompassed therein.

It is unlawful for any person to use or operate a skateboard on any private property within the boundaries described in 12.32.030 above, when there has been signs posted prohibiting the use of skateboards.

Every person skateboarding, roller blading, roller skating, or using any other coaster device at a publicly owned or operated facility for such use shall wear a helmet, elbow pads and knee pads while so skateboarding, roller blading, roller skating or using any other coaster device.

The public works department is hereby directed to post and maintain signs at all publicly owned skate parks within the county providing notice that any person riding a skateboard, skates, or using any other coaster device in the facility must wear a helmet, elbow pads and knee pads, and that any person failing to do so will be subject to citation for an infraction pursuant to section 1.20.030 of this code.

Any person violating any provisions of this chapter is guilty of an infraction punishable in accordance with the provisions of Section 1.20.030 of the Mariposa County Code as follows:

  1. A fine not exceeding one hundred dollars ($100), plus assessments as prescribed by law, and other sections relating thereto, for a first violation;

  2. A fine not exceeding two hundred dollars ($200), plus assessments as prescribed by law, and other sections relating thereto, for a second violation of the same ordinance within one (1) year;

  3. A fine not exceeding five hundred dollars ($500), plus assessments as prescribed by law, and other sections relating thereto, for each additional violation of the same ordinance within one (1) year.
