1.24.010 Property And Possession Of Sheriff

Any and all lost and unclaimed property in the possession of the sheriff's office shall be retained by the sheriff's office for a period of at least three (3) months from the date that the lost or unclaimed property is first obtained by the sheriff's office.

1.24.020 Disposal Of Property

After the three (3) month period described in Section 1.24.010 above has expired, the lost or unclaimed property shall:

  1. Be sold at public auction to the highest bidder, after notice of the time and place of said public auction has been given by the sheriff at least five (5) days prior to the time fixed for the sale, by publication once any newspaper of general circulation, or

  2. The property may be transferred to the county purchasing agent.

1.24.030 Redemption By Property Owner

Once the lost property or unclaimed property has been transferred to the county purchasing agent, it may not be redeemed by the property owner.

1.24.040 Sale By County Purchasing Agent

Once the lost or unclaimed property has been transferred to the county purchasing agent, the county purchasing agent may sell the lost or unclaimed property in a manner provided by Article VII, Chapter 5 of Part 2 of Division 2, of Title III of the California Government Code regarding sale of surplus personal property.

1.24.050 Detention Of Property By County

Notwithstanding the provisions of Section 1.24.040, if the county purchasing agent determines that the lost or unclaimed property which has been transferred to the county purchasing agent is needed for a public use, a lost or unclaimed property may be retained by the county for county use and not be sold.
