Chapter 2.52 — DISPOSAL OF SURPLUS TOWN PROPERTY

2.52.001. - Title.¶
The ordinance codified in this chapter shall be known as the "Uniform Town Surplus Ordinance."

2.52.010. - Definitions.¶
The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Exchange includes transactions wherein personal property not required for public use is transferred as consideration or partial consideration for the purchase of property by the Town.

2.52.020. - Disposal authorized.¶
The Town Manager, or any other officer of the Town designated by the Town Council, may, in the manner provided in this chapter, dispose of personal property of the Town not required for public use.

2.52.030. - Notice of surplus property, value estimate.¶
The Town Manager shall give notice in writing to the Purchasing Officer or agent (as defined in Section 3.20.030) that certain personal property is not required for public use and shall give an estimate of the market value thereof.

2.52.040. - Market value less than $10,000.00.¶
If personal property which is not required for public use is of a market value less than $10,000.00, the Town Manager may sell it without advertising for bids or may exchange it for other property. Notwithstanding the foregoing, effective on January 1, 2024, each year on January 1 the maximum value set forth in this section shall be increased by a percentage equal to the most recent year-over-year change in the Consumer Price Index for All Urban Consumers (CPI-U) for the Los Angeles-Long Beach-Anaheim area published by the State Department of Labor. For avoidance of doubt, the Department of Labor's CPI publishing schedule as of 2023 would require the use of the November 2022 and November 2023 CPI-U numbers for purposes of the calculation required by this section.

2.52.050. - Market value $10,000.00 or more.¶
If personal property which is not required for public use is of a market value of $10,000.00 or more, the Town Manager may sell or exchange it as provided by resolution or adopted policy of the Town Council, or as otherwise provided for in this Code. Notwithstanding the foregoing, effective on January 1, 2024, each year on January 1 the threshold value set forth in this section shall be increased by a percentage equal to the most recent year-over-year change in the Consumer Price Index for All Urban Consumers (CPI-U) for the Los Angeles-Long Beach-Anaheim area published by the State Department of Labor. For avoidance of doubt, the Department of Labor's CPI publishing schedule as of 2023 would require the use of the November 2022 and November 2023 CPI-U numbers for purposes of the calculation required by this section.

2.52.060. - Disposition of proceeds.¶
The amount received for any personal property sold or exchanged under the provisions of this chapter shall be credited to the Town's general fund.

2.52.070. - Purchase by Town personnel.¶
A Town officer or employee may purchase surplus Town property sold in accordance with this chapter unless the officer or employee has been involved in the decision to declare the Town property surplus or in the bid process. No member of the Town Council may purchase surplus Town property.
