9.08.010 Cemetery Name

The City Cemetery shall be known as the Mountain View Cemetery.

9.08.020 Definitions

A. Burial

“Burial” means the placement of human remains in a grave.

B. Cremated Remains

“Cremated remains” means human remains after incineration in a crematory.

C. Cremation

“Cremation” means the reduction of the body of a deceased person in a crematory and the placement of the cremated remains in a grave, vault, niche or burial at sea.

D. Grave

“Grave” means a space of ground in a burial park used or intended to be used for burial.

E. Interment

“Interment” means the disposition of human remains by inurnment, entombment, or burial in a cemetery, or in the case of cremated remains, by inurnment, entombment, burial, or burial at sea.

F. Lot; Plot; Interment Plot

“Lot,” “plot,” or “interment plot” means space in a cemetery used or intended to be used for the interment of human remains, such terms include and apply to, one or more than one adjoining graves, one or more than one adjoining crypts or vaults, or one or more than one adjoining niches.

9.08.030 Plot Sizes

A. Regular Plots

The sizes of regular plots for single graves in the Mountain View Cemetery shall be five (5) feet by ten (10) feet.

B. Baby Plots

The sizes of baby plots for single graves in the Mountain View Cemetery shall be three (3) feet by five (5) feet.

9.08.040 Payment

A. Payment

The total payment shall be collected on reservation of a plot. Total payment shall be collected on request for the opening and closing of each grave (with exception of County Estate Probate Funerals).
Fees shall be set by City Council Resolution.

B. Opening And Closing

The opening and closing of any plot for the interment of human remains shall be done by City personnel only.

C. Removal of Headstones

Fees for the removal of an existing headstone for access to open a grave shall be the owner of the plot’s responsibility.

9.08.050 Interment of Cremated Remains

The remains of a deceased person may be entered in the same plot, with the remains of another with the consent of the City of Loyalton and the written consent of one of the following in the order named:

(1) Surviving Spouse (2) Surviving Children (3) Surviving Parents (4) Surviving Brothers or Sisters

A copy of the written consent must be on file with the City Clerk of Loyalton prior to the opening and closing of the grave.

9.08.060 Burial Standards

The top of every coffin, if no liner is provided, or with a liner, deposited in any grave in the Mountain View Cemetery shall be at least four (4) feet beneath the natural surface of the earth. The top of any rough box or other coffin receptacle shall be secured by at least four (4) wood screws. All curbing shall be put inside the property lines.

9.08.070 Funerals

All funerals held in the Mountain View Cemetery shall take place between the hours of 8:00 a.m. and 6:00 p.m. The City Clerk shall be notified at least twenty-four (24) hours prior thereto whenever such burial service is to take place.

9.08.080 City Purchase of Plots

The City Council may authorize the purchase of burial plots purchased by any individual in the past. The City shall only purchase burial plots upon request of the plot owner and shall be restricted to a purchase price of one-half (1/2) of the original purchase price to the most recent owner of the burial plot.

9.08.090 Cemetery Restrictions

A. Animals

No animals shall be allowed inside the Mountain View Cemetery to wander around the grounds or to be buried in a plot.

B. Destruction of Plants and Birds

It shall be unlawful for any person to cut, break, remove, or in any way destroy or injure any tree, shrub, plant, or flower, or to destroy birds, except during regular maintenance of the cemetery grounds by city employees.

C. Damage and Entering

Any person cutting, marking, or in any way disfiguring or damaging any tombstone, monument, stake, fence, post, rail, or wall shall be guilty of a misdemeanor.

D. Gates

The drive through gates to the Mountain View Cemetery shall be locked at all times. Anyone wishing to drive into the Cemetery must check out a key at the City Clerk’s office. A walk through gate will be open at all times.
