6.28.010 Animals – Prohibited¶
(A) (1) It shall be unlawful for any person, firm, corporation, partnership or association to keep or cause to be kept, in or upon any lot or property within the City, any large livestock such as hoses, cattle, mules, donkeys, or any small livestock, such as sheep, goats and hogs without obtaining a Special Use Permit from the City Planning Commission.
(A) (2) A Special Use Permit shall be issued for the keeping of large livestock only if the applicant shall have available for housing such livestock a lot of at least 5,000 square feet, that is separate and apart from the applicant’s residential lot, with adequate fencing and shelter.
(A) (3) The City Planning Commission shall determine whether more than one large livestock animal shall be permitted on each 5,000 square foot lot based on the type of livestock, fencing, shelter, nearness to neighbors or property lines, and any other factors deemed relevant by the City Planning Commission.

6.28.010 (Continued) (A) (4) No particular size enclosure, and no separate lot, shall be required for the keeping of small livestock; provided, however, that the City Planning Commission shall determine how many small livestock shall be permitted on a lot based on the type of livestock, fencing, shelter, nearness to neighbors or property lines, and any other factors deemed relevant by the City Planning Commission; and provided further that no more than three small livestock may be kept on any lot unless the City Planning Commission adopts a finding that there are compelling reasons for allowing more than three small livestock, and states in such finding what all of such compelling reasons are. (A) (5) All large and small livestock within the City at the time of adoption of this ordinance which are in compliance with all existing City ordinances shall be permitted to remain, despite the size and nature of the enclosure, fencing and shelter, provided that the owner of such existing livestock applies for and obtains a Special Use Permit within sixty (60) days of adoption of this ordinance, and pays the fees set forth below. (B) No game birds, exotic animals, chickens, geese, ducks, turkeys, rabbits, or other small mammal or fowl may be kept in or upon any lot or property within the City without a Special Use Permit issued by the City Planning Commission. (C) The City Health Officer shall have the authority to determine a nuisance caused by any animal or fowl, or any type, and may order immediate abatement whether or not such animal or fowl is permitted under this chapter. (D) The fee for a Special Use Permit for large livestock shall be $100 per animal per year. The fee for a Special Use Permit for small livestock shall be $50.00 per animal per year. The fee for a Special Use Permit for a small mammal or fowl shall be $5.00 per animal per year. If application for a Special Use Permit for large or small livestock is made by a 4‐H Club, FFA, or other recognized scientific or educational organization on behalf of its members, shall be exempt from all fees. All application fees for a Special Use Permit are to be prepaid. If permits are denied one half of application fee of $100.00 will be refundable, if fees are under $100.00 fees will not be refundable. (E) Prior to considering an application for a Special Use Permit, the City Planning Commission shall hold at least one (1) public hearing upon the question of whether to grant or deny the application. Notice of such hearing shall be given by mail to all property owners that are contiguous to the applicant’s lot or located directly across a residential street from the applicant’s lot, stating a brief description of the property, the type of animal described in the application, and the time and place of the hearing. Such notice shall be mailed at least ten (10) days prior to the hearing. Failure of any property owner to receive such notice shall not invalidate the proceedings. In addition, notice of the hearing shall be posted in at least three (3) public places within the City of Loyalton. The requirement of the public hearing shall be waived for a 4‐H Club Member, FFA Member, or Member of any other recognized scientific or education organization provided the Special Use Application is submitted with signatures of acknowledgement and approval by all contiguous neighbors of the property where the livestock animal shall be housed. Without the signatures of acknowledgment and approval by all contiguous neighbors the Special Use Permit Public Hearing Process set forth herein would be in full force and affect. (F) No Special Use Permit shall be issued unless the City Planning Commission finds that the existence of the animal described in the application, upon the property described in the application, will not, under the circumstances of the particular case, be detrimental to the health, safety, peace, moral comfort and general welfare of persons residing within the neighborhood of such proposed use, or will
6.28.010 (Continued) not be detrimental or injurious to property improvements in the neighborhood or to the general welfare of the City. (G) In any case where the conditions to the granting of the Special Use Permit have not been, or are not, complied with, the Planning Commission shall give notice to the permittee of intention to revoke such permit at least ten (10) days prior to a hearing thereon. Following such hearing, the Planning Commission may revoke such permit.
