6.16.010 Ordinance¶
Any tree found on city or private property which overhangs public property, and is deemed dangerous or hazardous by the Council shall be removed or pruned at the Council’s discretion.
6.16.020 Definitions¶
“Dangerous” or “Hazardous” shall be any tree which:
- Obstructs the view of passing traffic.
- Has deteriorated to a point which may fall onto a public path or throughfare.
- Has long branches overhanging public throughfares and causes obstruction to passing vehicles and/or snow removal equipment.
6.16.030 Notice of Intent to Remove or Prune¶
When the Council determines that a tree should be removed or pruned in compliance with this chapter, written notice shall be provided to the property owner upon which the tree is found, giving him thirty (30) days to provide compliance.
6.16.040 Method of Removal¶
A property owner which is the subject of a “notice of intent” shall have the tree removed or pruned in a manner prescribed by the City Engineer. Upon expiration of the thirty (30) day period, the Council will act to remove or prune said tree is the property owner has failed to do so.
6.16.050 Cost of Removal or Pruning¶
Any cost for the City to remove or prune any tree on private property shall be a responsibility of the private property owner. Any City costs incurred shall be added to the property owner’s water bill.

6.16.060 Objections to Removal or Pruning¶
A property owner which has received a “Notice of Intent” may appeal such notice by appearing before the City Council.
