6.08.010 Fire Permit Required

A permit issued in compliance with this chapter shall be required for all controlled burning of any combustible materials or substances outside of approved incinerators or fire pits.

6.08.020 Fire Permits and Notices

A. The Fire Chief or any officer or member of the fire department designated by the Chief, is hereby authorized and empowered to issue any permit required by this chapter. B. Any order or notice required to be given by the provisions of this chapter shall be in writing, and signed by the Fire Chief or other authorized officer or member thereof. Such order or notice shall be personally served upon the owner, or occupant in possession of the property or premises affected thereby. In the event that neither the owner, occupant, or person in charge of the premises can be located thereon, then the order or notice shall be sent by registered mail directed to the owner or tenant or reputed owner or tenant of the property, at his last known post office address. C. The Fire Chief shall have the right to refuse to issue a fire permit, or allow the burning of any combustible material in any case where, in his opinion, such burning would be dangerous or unsafe.

6.08.030 Controlled Burning

It shall be lawful to set fire to, ignite, or burn any combustible materials or substances in any outdoor fireplace, grill or barbecue pit; provided, that the fire is under competent and continuous supervision and all inflammable and combustible material is removed a sufficient distance therefrom so as not to constitute a fire hazard; and further provided, that all fires and coals is the fireplaces, grills, or pits shall be thoroughly extinguished after the use thereof has been completed.

No person shall at anytime or place in the City set fire to, ignite, or burn garbage, hair, bags, animal waste matter, or other materials likely to create offensive odors or excessive smoke.

It shall be unlawful for any person except an officer or employee of the City within the line of his duty, to set fire to, ignite, or burn any combustible material or substance upon any street, alley, sidewalk, park, park way, or public property within the City.

6.08.040 Permissive Burning Hours

Upon issuance of a burning permit, permitted hours for burning shall be between the hours of six (6) a.m. and twelve (12) noon of any given day, provided that notice has been given to the Fire Chief.

6.08.050 Approved Incinerator

Any burning of refuse on outside private property during authorized hours shall be done only in properly screened and otherwise approved containers or incinerators, as the same shall be approved by the Fire Chief or his duly authorized representative.

6.08.060 Fireworks Prohibited

It is unlawful for anyone to discharge fireworks of any manner in the City of Loyalton.
