§ 4-1.01. Licenses: Required.

It is unlawful for any person to operate or use a bicycle propelled wholly or in part by muscular power upon any of the streets, alleys, or public highways in the City without first obtaining from the Police Department a license therefor.

§ 4-1.02. Licenses: Issuance.

The Police Department shall issue, upon a written application, bicycle licenses which, when issued, shall entitle the licensee or his or her nominee to operate such bicycle for which the license has been issued upon all the streets, alleys, and public highways, exclusive of sidewalks, in the City as long as the licensee is the owner of such bicycle.

§ 4-1.03. Licenses: Issuance: Records.

The Police Department shall keep a record of the date of issuance of each bicycle license, to whom issued, and the number thereof.

§ 4-1.04. Licenses: Plates, seals, and registration cards.

The City shall provide licenses and registration cards for bicycles licensed pursuant to the provisions of this chapter. The license shall be suitable for attachment upon the frame of a bicycle, and the Police Department shall attach one such license plate to the frame of each bicycle and issue a corresponding registration card to the licensee upon the payment of the license fee set forth in Section 4-1.06 of this chapter. Such license shall remain attached during the existence of such license.

It is unlawful for any person to wilfully or maliciously remove, destroy, mutilate, or alter the number of any bicycle frame licensed pursuant to the provisions of this chapter. It shall also be unlawful for any person to remove, destroy, mutilate, or alter any license plate, seal, or registration card during the time such license plate, seal, or registration card is operative; provided, however, the provisions of this section shall not prohibit the Police Department from stamping numbers on the frames of bicycles on which no serial number can be found or on which the number is illegible or insufficient for identification purposes.

§ 4-1.06. Licenses: Fees.

The license fee for each bicycle shall be One and No/100ths ($1.00) Dollar, which shall be paid at the time the bicycle license is applied for. Such license may be transferred as set forth in Section 4-1.07 of this chapter, and a fee of One and No/100ths ($1.00) Dollar shall be paid for the registration of such transfer. All license fees collected pursuant to the provisions of this chapter shall be paid into the General Fund of the City.

§ 4-1.07. Transfer of ownership: Registration.

Every person who sells or transfers the ownership of any bicycle shall report such sale or transfer by returning to the Police Department the registration card issued to such person as the licensee thereof, together with the name and address of the person to whom the bicycle was sold or transferred. Such report shall be made within five days after the date of such sale or transfer. It shall be the duty of the purchaser or transferee of such bicycle to apply for a transfer of registration therefor within five days after such sale or transfer. The fee for the registration of such transfer shall be as set forth in Section 4-1.06 of this chapter.

§ 4-1.08. Dealers: Reports.

All persons engaged in the business of buying secondhand bicycles shall make a report to the Police Department of all purchases of secondhand bicycles made by such dealers, which report shall include the name and address of each person from whom a bicycle is purchased, the description of each bicycle purchased, the frame number thereof, and the number of the license tag found thereon, if any. All persons engaged in the business of selling new or secondhand bicycles shall make a report to the Police Department of all sales made by such dealers, which report shall include the name and address of each person to whom a bicycle is sold, the kind of bicycle sold, a description thereof, the frame number thereof, and the number of the license tag attached thereto, if any. The reports required by this section shall be made within five days after each such purchase or sale.

§ 4-1.09. Riding on sidewalks prohibited.

It is unlawful for any person to ride a bicycle on any public sidewalk in a business district within the City.

§ 4-1.10. Business district defined.

For the purposes of this chapter, "business district" shall be defined as any public sidewalk which borders any commercial building.

§ 4-1.11. Violations: Penalties.

Any person violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and, upon conviction, shall be punishable as set forth in Chapter 2 of Title 1 of this Code. In addition to such penalties, any member of the Police Department may impound and retain possession of any bicycle operated in violation of any of the provisions of this chapter until the license provided for in this chapter is obtained by the owner of the bicycle.
