§ 10.52.040. Bicycle Licenses Required.¶
No person who has owned and possessed a bicycle within the City for a period of 30 days shall ride or propel a bicycle on any street or bikeway within the City unless such a bicycle has been licensed and a license attached thereto as provided in this Chapter.

§ 10.52.050. Application—Fee.¶
A. Any person required or desiring to license a new or used bicycle under the provisions of this Chapter shall apply to any bicycle dealer or agent doing business within the City. Such person shall furnish the bicycle dealer with satisfactory proof of ownership, name and address of the owner, the serial number of the bicycle, if available, the make and brand name of the bicycle, its type, model, name or number, year first sold, number of gears or speeds and color. No bicycle dealer or his or her agent shall issue a license without presentation of satisfactory proof of ownership.
B. A registration fee of six dollars for each new and three dollars for each renewal license with registration being valid until January 1st of the third year following the year of registration. Registration shall be paid in advance and upon application for a license. For having registered and licensed a new or used bicycle, or renewed a license, the bicycle dealer shall retain one dollar, thereof, as his or her fee and shall transmit the remainder of the fee to the City.

§ 10.52.060. Transfer.¶
A. Whenever the owner of a bicycle licensed pursuant to this Chapter sells or otherwise disposes of the bicycle, the owner shall, within ten days, notify the Police Department of such disposition.
B. Any person who purchases or otherwise acquires possession of a registered and licensed bicycle shall, within ten days of taking possession, apply for the transfer of the license to his or her name. The transfer of a license shall be accomplished in the same manner as for licensing provided in Section 10.52.050 for a fee of one dollar per year, except that the applicant shall furnish the name and identifying information concerning the prior licensee.
C. Whenever the owner of a bicycle license, pursuant to this Chapter, changes his or her address, he or she shall, within ten days, notify the Police Department of the old and new address.

§ 10.52.070. License—Form—Attachment.¶
A.
The license shall be the bicycle license indicia issued by the State Department of Motor Vehicles. The Chief of Police shall obtain the indicia from the Department and supply it to bicycle dealers within the City.
The licenses shall be for the term provided by, and shall expire upon the dates provided by, the State Department of Motor Vehicles. Upon the expiration of any bicycle license, a new or renewed license shall be obtained.
B. The license shall be attached to the frame of the bicycle in a manner prescribed by the Chief of Police. The issuer of the license shall immediately attach it to the frame of the bicycle for which it is issued. No person shall remove the license from the bicycle unless the bicycle is destroyed or the frame is included in a newly constructed bicycle which itself is to be licensed. No person not the legal owner of the bicycle shall remove the license.
C. The licensing application or registration forms shall include the number of the license issued.

§ 10.52.080. Frame Numbers.¶
A. The Chief of Police may arrange for the stamping of unique numbers on the frame of bicycles upon which no manufacturer's serial number can be found, or on which the manufacturer's serial number is illegible or insufficient for identification purposes. The control and issuance of such new identification numbers is the sole prerogative of the Chief of Police.
B. Bicycles which are altered, repaired, or painted in such a way as to conceal or remove the required license, serial number, frame number or other distinguishing marks must be relicensed and renumbered.
C. Every person engaged in the business of selling new or used bicycles or bicycle frames shall die stamp a symbol and serial number, or either, as designated by the Chief of Police, on the frame of bicycles on which no manufacturer's serial number can be found or which is illegible or insufficient for identification of said frame.

§ 10.52.090. Responsibility of Bicycle Dealers.¶
A. No bicycle dealer shall sell or trade a bicycle within the City, unless said bicycle is first licensed as provided in this Chapter.
B. A bicycle dealer shall require the application for, and issue a license for, any unlicensed bicycles which he or she sells or trades. He or she shall issue the license and record the issuance upon the forms provided therefore by the City. He or she may retain his or her portion of the fee and shall forward the balance of all fees collected to the City, together with the registration forms, thereof, at least monthly.
C. All persons operating bicycle rentals or leasing agencies shall license all bicycles used in the business as required by this Chapter. No license shall be transferred between such bicycles.

§ 10.52.100. General Regulations.¶
A. No license shall be issued for any bicycle which is in an unsafe mechanical condition, or which does not have reflectors or lights as required by law.
B. A bicycle parked or left standing in a public place, which bears no City license, may be impounded until such time as the owner purchases any required bicycle license.
C. The failure of an owner to claim an impounded bicycle, within seven days after notification of storage by the Police Department, will result in a charge of 25 cents per day storage fee, commencing on the eighth day.
D. The Chief of Police may designate authorized agents who voluntarily issue new and renewed licenses under this Chapter. Members of the City Fire Department may also issue such licenses.

§ 10.52.110. Violations.¶
In accordance with Vehicle Code Section 39012, the City shall have the right to impound and retain possession of any bicycle in violation of provisions of this Chapter, and may retain possession of such bicycle until the provisions of this Section are complied with.
