Sec. 4-4.10. - Application of article.

The provisions of this article 3 shall be in addition to all other provisions of this chapter 4 and shall not be construed to supplant or supersede the remaining provisions of this chapter. Except as expressly regulated in this article 3, the remaining provisions of this chapter shall apply.

Sec. 4-4.11. - Construction equipment and power tools—Unlawful use.

(a) It shall be unlawful and a misdemeanor, subject to punishment in accordance with section 1-2.01 et seq. of this Code, for any person within the City of Lomita to operate construction equipment or power tools in the performance of any outside construction or repair work on buildings, structures, or projects in or adjacent to a residential area, except between the hours of 7:00 a.m. to 6:00 p.m., Monday through Friday, except Holidays, and 9:00 a.m. to 5:00 p.m. Saturday, Sunday, and Holidays, unless performing emergency work as defined in this chapter. During the lawful times of use, such construction equipment and power tools shall not reach a dB level of more than thirty-five (35) dB for a cumulative period of fifteen (15) minutes in any given hour at any receiving property line. It shall be unlawful and a misdemeanor, subject to punishment in accordance with section 1-2.01 et seq. of this Code, for any such equipment or tools to be delivered or removed from the construction site at any time other than the hours and days specified above.

(b) Solid waste collection service hours shall be in accordance with Title V, "Sanitation and Health," Chapter 3, "Integrated Waste Management," of this Code.

Sec. 4-4.12. - Residential power tools and maintenance equipment—Unlawful use.

(a) It shall be unlawful and a misdemeanor, subject to punishment in accordance with section 1-2.01 et seq. of this Code, for any person to use or to operate or cause to be used or operated any type of residential power tools and maintenance equipment within or adjacent to a residential area except between the hours of 8:00 a.m. and 6:00 p.m., Monday through Friday, excluding holidays, and 9:00 a.m. to 5:00 p.m., Saturday, Sunday, and holidays. The use of such power tools and equipment for emergency work, as defined in this chapter, at any time as necessary, shall not violate the provisions of this section.

(b) Solid waste collection service hours shall be in accordance with Title V, "Sanitation and Health," Chapter 3, "Integrated Waste Management," of this Code.

Sec. 4-4.13. - Leaf-blowing machines—Unlawful use.

(a) It shall be unlawful and a misdemeanor, subject to punishment in accordance with section 1-2.01 et seq. of this Code, for any person to use or to operate or cause to be used or operated any type of leaf-blowing machine within a residential area except between the hours of 8:00 a.m. and 6:00 p.m., Monday through Friday, excluding holidays, and 9:00 a.m. to 5:00 p.m., Saturday, Sunday, and holidays.

(b) It shall be unlawful and a misdemeanor, subject to punishment in accordance with section 1-2.01 et seq. of this Code, for any person to use or operate or cause to be used or operated a leaf blower in such a manner as to blow, dispel, or make airborne, leaves, grass cuttings, paper, trash or any other type of unattached debris or material, which by its use will intentionally cause said leaves, grass cuttings, paper, trash, or other type of unattached debris or material to become airborne or travel beyond the property boundaries of the parcel on which it is being used, to adjoining properties, or public rights-of-way within the city and to remain there for more than fifteen (15) minutes.

(c) It shall be unlawful and a misdemeanor, subject to punishment in accordance with section 1-2.01 et seq. of this Code, to use any type of leaf-blowing machine or device without a full nozzle extension utilized to ensure maximum efficiency and to minimize the spread of dust.

(d) It shall be unlawful and a misdemeanor, subject to punishment in accordance with section 1-2.01 et seq. of this Code, for any person to use or operate or cause to be used or operated any type of leaf-blowing machine or device within a residential area at a noise level greater than sixty-five (65) decibels.

(e) It shall be unlawful and a misdemeanor, subject to punishment in accordance with section 1-2.01 et seq. of this Code, for any individual, company, or corporation doing business in the City of Lomita, which business includes the use of a leaf blowing machine, to use a leaf blowing machine in a residential area unless it is certified annually by the city. The fee for said certification shall be twenty-five dollars ($25.00). A sticker indicating certification shall be provided which shall be affixed on the body of the leaf blower itself or the vehicle of such business.
