Lomita Municipal Code Ch. 13 Garage and Yard Sale Regulations

Sec. 4-13.01. - Definitions.

Whenever any of the following terms are used in this chapter, each such term shall be deemed and construed to have the meaning ascribed to it as follows:

(a) Garage or yard sale shall mean a sale of personal property held at a private single-family residence or multi-family property by the owner, owners, tenants or occupants thereof.

(b) Multi-family property shall mean an apartment complex, mobilehome park, or condominium complex or other similar multi-family complexes, and includes both the private residences and common areas of such properties.

(c) Management entity shall mean a multi-family property owner, property manager, homeowners' association, or similar management entity of a multi-family property.

Sec. 4-13.02. - Garage and yard sale restriction.

No person or management entity shall conduct or allow to be conducted on any private single-family residence or any multi-family property, a garage or yard sale in violation of any of the following regulations:

(a) A garage or yard sale shall not be held for more than three (3) consecutive weekends and shall only be held on Saturdays and/or Sundays.

(b) No more than three (3) garage or yard sales shall be conducted at the same private residence in any one (1) calendar year.

(c) No more than three (3) garage or yard sales shall be conducted at the same multi-family property (including the private residences and common areas located therein) in any one (1) calendar year. All management entities of multi-family properties located within the city shall notify all of their tenants, condominium owners, mobilehome owners and other residents of the requirements of this chapter. The management entity shall schedule three (3) weekend dates for holding garage or yard sales for the entire multi-family property and post or otherwise provide notice of such dates to all of their tenants, condominium owners, mobilehome owners and other residents. The tenants, condominium owners, mobilehome owners and other residents of multi-family properties shall only be permitted to conduct a garage or yard sale on the three (3) weekend dates scheduled by their management entity.

(d) Garage or yard sale activity may not be conducted in the public sidewalks, parkways, streets, alleys or within the public right-of-way or on any public property, unless the public entity owning the property has given prior written consent to such garage or yard sale activity.

(e) Garage or yard sale activity and display of personal property intended for sale at a garage or yard sale shall be prohibited between the hours of 5:00 p.m. and 6:00 a.m.

Sec. 4-13.03. - Penalty.

Violation of section 4-13.01 shall be deemed an infraction for the first violation with a fine of one hundred dollars ($100.00). The second or third violations of section 4-13.01 shall be punishable by a fine of two hundred fifty dollars ($250.00). More than three (3) violations of section 4-13.01 in any twelve-month period shall be deemed a misdemeanor.
