Lomita Municipal Code Ch. 12 Driving Under the Influence

The city council of the City of Lomita is hereby authorized to impose a fee on drivers arrested for driving under the influence of drugs or alcohol pursuant to California Vehicle Code section 23152, for the costs of law enforcement services and administrative processing. Drivers shall be exempted from the processing fee in any of the following circumstances:

(1) The driver's vehicle was impounded and a fee assessed pursuant to City of Lomita Resolution No. 96-36 and its successors if any be applicable.

(2) The driver was released from custody for insufficient grounds for making a criminal complaint as provided in Penal Code section 849(b)(1).
