15.06.010 - Establishment.

In order to determine the suitability of alternate materials and types of construction and to provide for reasonable interpretations of the provisions of the California and International Codes enumerated in Chapter 15.04, there is established a building board of appeals, consisting of five members, who shall be qualified by experience and training to pass upon matters pertaining to building construction and code enforcement matters.

15.06.040 - Terms.

The terms of each board member shall be four years, except for the initial appointments, and shall run concurrently with the term of the city council member who nominated that board member.

15.06.050 - Powers and duties—Appeals.

(a) The building board of appeals shall have the authority as provided in Section 113 of the International Building Code with California Amendments and shall hear appeals from all decisions of the building official, including the denial of a variance from the provisions of this chapter, and shall also hear requests for variances from any provision of this chapter referred to it by the building official or community development director. Upon such references, or upon appeal, it shall have the same power as the building official to grant such variances and impose conditions thereon.

(b) Appeals to the building board of appeals shall be in writing and shall be filed with the city clerk no later than ten days from the date of the decision of the building official.

(c) Members of the building board of appeals shall serve without compensation; however, the city council may reimburse said members for reasonable expenses incurred in the performance of their duties.

(d) Any person, including city staff, may appeal a decision of the building board of appeals to the city council. The appeal shall be in writing and filed with the city clerk no later than ten days from the date of the decision of the building board of appeals and shall be accompanied by a fee in an amount established by resolution of the city council.
