§ 9.48.010. Application and authority.

The provisions of this chapter shall be applicable to all aircraft operating on or over any airport owned by the county. The provisions of this chapter shall be construed to supplement federal and state laws when not expressly inconsistent therewith concerning the conduct of aircraft on or over airports owned by the county, and the regulations provided in the Federal Aviation Administration Regulations are adopted as part of this chapter.

§ 9.48.020. Definitions.

For the purpose of this chapter, certain words and phrases used in this chapter are defined as follows:

"Aircraft"

means any contrivance used or designated for navigation in the air, whether self-propelled by machine or not.

"Person"

means any individual, firm, partnership, corporation, company, association, joint stock association or body politic, except the United States, the state and the county, and includes any agent, trustee, executor, receiver, assignee or other similar representative thereof.

"Pilot"

means the person operating the aircraft on or over the airports of the county.

§ 9.48.030. Only certified persons shall be pilots.

No person shall pilot any aircraft on or over any airport of the county unless he has been properly certified by the Federal Aviation Agency; provided, that this restriction shall not apply to aircraft belonging to the United States, a state, territory, possession of any political subdivision thereof, or to any aircraft of a foreign country operated under permission of the United States.

§ 9.48.040. Aircraft awaiting takeoff.

Any aircraft awaiting takeoff from any airport of the county shall be parked in such a position so as to afford the pilot thereof a direct view of possible aircraft approaching for landing, and the pilot shall not commence takeoff before ascertaining that no aircraft is in final approach for a landing on that runway, and that the runway to be used for takeoff is itself clear of landing or taxiing aircraft.

§ 9.48.050. Careless or reckless operations of aircraft.

Any person who operates any aircraft in a careless or heedless manner so as to be indifferent to the person or property of others or in such a manner as to endanger the life or limb or damage the property of any person shall be guilty of the crime of careless or reckless operation and shall be punishable in accordance with the provisions of this chapter.

§ 9.48.060. Use of taxiways.

No person operating a fixed-wing aircraft shall land or takeoff from any airport owned by the county except on the runway or runways designed for takeoff.

§ 9.48.070. Aircraft taking off.

All aircraft after takeoff shall not deviate from a straight course until after passing the boundaries of the airport.

§ 9.48.080. Traffic pattern for county airports.

The traffic pattern for all county airports shall be a standard left-hand pattern and the altitude shall be eight hundred feet above ground level of the surface of the runways.

§ 9.48.090. Unauthorized entry prohibited.

It is unlawful for any person to go upon on foot or operate any motor vehicle, bicycle or other means of mechanical conveyance or to ride or lead any animal upon, or allow any animal to go or remain upon, that portion of any airport owned, operated or maintained by the county of Lassen which is designated, delineated or used as a runway, landing strip, helipad or other area for the takeoff, landing or taxiing of aircraft.

§ 9.48.100. Sign erection.

The department of public works of the county of Lassen may erect or cause the erection and placement of appropriate signs at each county-maintained airport warning of the provisions of this chapter.

§ 9.48.110. Exemptions.

Section 9.48.090 shall not apply to persons alighting from, nor embarking upon aircraft, nor to any person having in his immediate possession the written authorization of the director of public works of the county of Lassen to conduct any activity described in said section.

§ 9.48.120. Violation—Penalty.

Any person violating any provision of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than five hundred dollars or by imprisonment in the Lassen County Jail for a period of not to exceed six months, or by both such fine and imprisonment.
