§ 9.40.010. Definitions.

The following words and phrases when used in this chapter shall be construed to have the following meanings:

"Christmas tree"

means the top or any portion of any evergreen tree severed from the remainder of the tree with the intent that such top or portion will be used for decorative purposes;

"Person"

means any natural person, whether acting for himself, for any firm or corporation, or for an absent person, excepting any employee of such natural person while he is working in the presence and under the supervision of such natural person;

All words in the masculine gender shall be construed to include the feminine and all words in the singular number shall be construed to include the plural.

§ 9.40.020. Cutting Christmas trees without filing notice of intent.

(a) It is unlawful for any person, owners of the land or otherwise, to cut more than five Christmas trees in the unincorporated territory of Lassen County, without having previously filed with the county sheriff, a "notice of intention to cut Christmas trees," on a form provided by the sheriff and containing the following:

(1) A statement of the approximate number of Christmas trees to be cut, specifying species;

(2) A description of the land upon which the Christmas trees are to be cut, and description of the land upon which the Christmas trees are to be stored pending shipment;

(3) The dates between which the Christmas trees are to be cut;

(4) The signature of the person proposing to cut such Christmas trees.

(b) Any person filing a "notice of intention to cut Christmas trees" as set forth in subsection (a) shall obtain from the sheriff and carry on his person at all times while cutting Christmas trees a validated copy of the "notice of intention to cut Christmas trees."

(c) It is unlawful for any person to cut five Christmas trees or less from lands not his own and in the unincorporated territories of Lassen County without first obtaining written, notarized consent from the owner of the lands where the trees are cut and shall carry on his person the written, notarized consent at all times when he is cutting Christmas trees.

§ 9.40.030. Transporting Christmas trees without a permit.

It is unlawful for any person to transport more than five Christmas trees over any public road within Lassen County without having in his possession a Christmas tree transportation permit containing the following:

(1) The approximate number of Christmas trees being transported;

(2) The dates during which such transporting is authorized;

(3) The license number, make, and description of the vehicle upon which the Christmas trees are being transported;

(4) The written, notarized consent to such transportation dated and signed by the owner or owner's representative of the Christmas trees;

(5) The written authorization for such transportation of Christmas trees dated and signed by a Federal Forest Officer, officer of the State Division of Forestry, or peace officer having jurisdiction in the district from which such Christmas trees are to be shipped. Before transporting the trees from Lassen County, every person transporting any Christmas trees shall have in his possession, while so transporting, the transportation permit covering such shipment and shall cause this permit to be validated by a Federal Forest Officer, officer of the State Division of Forestry, or peace officer having jurisdiction in the district of the county.

This section shall not apply to the transportation of Christmas trees cut outside of Lassen County and transported in interstate commerce.

§ 9.40.040. Notice to sheriff.

Written notice to the sheriff in the form provided by the sheriff, shall be completed as to all applicable items, and filed with the county sheriff at or before the time that the notice of intent prescribed by Section 9.40.020 is filed with the sheriff. This notice shall be signed and notarized by the owner of the land, or by a person having written, notarized authority from the owner to sell any such trees as a lessee or purchaser of the lands.

§ 9.40.050. Display of permits.

It is unlawful for any person cutting or transporting Christmas trees within the county to fail or refuse to display to any peace officer on demand any of the permits, notices or consents provided for in this chapter.
