§ 9.18.010. Definitions.

For the purposes of this chapter, the words set out in this section shall have the following meanings:

"Facility"

means any disposal site, transfer station, dump, incinerator or other installation operated in the county of Lassen for the deposit of solid wastes.

"Resident"

means a person having his place of abode within the county of Lassen.

"Solid waste"

means and includes all putrescible and nonputrescible solid and semisolid wastes, such as refuse, garbage, rubbish, paper, ashes, industrial wastes, demolition and construction wastes, abandoned vehicles and parts thereof, discarded home and industrial appliances, manure, vegetable or animal solid and semisolid wastes, and other discarded solid and semisolid wastes, and also includes liquid wastes disposed of in conjunction with solid wastes at solid waste transfer/processing stations or disposal sites, but excludes:

(1)

Sewage collected and treated in a municipal or regional sewerage system; or

(2)

Materials or substances having commercial value which have been salvaged for reuse, recycling or resale.

"Waste"

means and includes "solid waste."

§ 9.18.020. Prohibited acts.

It is unlawful for any person not a resident of Lassen County to dispose or have dispensed solid waste in any facility operated in Lassen County.

§ 9.18.030. Violation—Penalty.

A violation of any provision of this chapter constitutes an infraction and is punishable by a fine not exceeding one hundred dollars for a first violation, a fine not exceeding two hundred dollars for a second violation of any provision of this chapter within one year, and a fine of five hundred dollars for each additional violation within one year.

§ 9.18.040. Facilities or persons exempt from chapter provisions.

This chapter shall not be applicable to facilities of special districts within Lassen County, specifically, the Westwood and Susanville Consolidated Sanitary Districts for the purpose of septic tank/vault toilet wastes, nor to persons entering into contracts with the county to dispose of solid waste in county, special district or private facilities.
