16.7 General.

This section is enacted pursuant to the general police power of the County and is for the

purpose of protecting the health and safety of persons using watercraft launch facilities located in County parks. The County's five (5) improved watercraft launch facilities provide primary access to Clear Lake. It is necessary and in the best interests of the public to restrict activity on the courtesy docks and ramps constructed for launching and retrieval of watercraft in order to prevent injuries and traffic congestion both on land and in the water.

Upon enactment of this section, appropriate signs shall be placed at said watercraft launch facilities evidencing the provisions of this section.

16.7.1 Definitions.

(a)

Courtesy dock shall mean any dock, pier or platform adjacent to an improved or unimproved ramp provided for the purpose of loading and unloading passengers from watercraft.

(b)

Boat launch facility shall mean the general area that includes any ramp, improved or unimproved, from which watercraft may be launched.

(c)

County parks shall include Lakeside Park (2), 1985 Park Drive, Lakeport; Lucerne Harbor County Park (1), 6225 E. Hwy 20, Lucerne; Clearlake Oaks Beach County Park (1), 12684 Island Drive, Clearlake Oaks; and Keeling Park (1), 1000 Lakeshore Blvd, Nice.

16.7.2 Prohibition.

No person shall swim, sunbathe or play on or within fifty (50) feet of any courtesy dock or watercraft launch facility located in a County park, unless within a designated swim area.

16.7.3 Infraction Penalty.

(a)

It shall be unlawful and constitute an infraction for any person to violate this section. Any violation shall be punishable by a fine not to exceed fifty dollars ($50.00) for a first offense, one hundred dollars ($100.00) for a second offense within one (1) year of the first offense, and two hundred dollars ($200.00) for each additional offense committed within one (1) year of the first offense.
