Sec. 40-287. - Defined.

For the purpose of this chapter, the term "bicycle" means any device upon which a person may ride, which is propelled by human power through a system of belts, chains or gears and which has wheels at least 20 inches in diameter and a frame size of at least 14 inches.

Sec. 40-288. - Registration—Required.

No person shall operate or permit to be operated on any public street in the City any bicycle unless such bicycle shall first have been registered with the Police Department as provided in this article.

Sec. 40-289. - Same—Date required.

(a) Any person owning or having charge or control of a bicycle, excepting dealers thereof, shall within 90 days after January 1, 1975, register such bicycle with the Police Department.

(b) All bicycles registered with the Police Department prior to December 31, 1974, pursuant to City Ordinance Number 169, shall remain valid for a period not exceeding five years from the effective date of the ordinance from which this article is derived.

Sec. 40-290. - Same—Application; fee; number generally.

(a) The application for registration shall be made in writing to the Police Department upon forms provided by that department, stating the name of the applicant, his address, a description of the bicycle, including the factory number thereof, the name of the person from whom the bicycle was purchased, color thereof and any other information relative thereto as may, in the judgment of the Police Department, be necessary and proper for the identification.

(b) Upon receipt of such application and a $2:00 registration fee from the applicant, the Police Department shall register such bicycle in a permanent register maintained by the department and such bicycle shall be given an identifying license number. The registration shall be valid for three years.

(c) The license numbers will be obtained from the State Department of Motor Vehicles per Vehicle Code § 39001 and Assembly Bill No. 3329.

Sec. 40-291. - Same—Certificate; number sticker; renewal.

(a) The Police Department shall issue to such applicant a registration certificate and license number sticker, which must also be entered in the department's permanent register and shall affix the license number sticker upon the vertical riser immediately below the seat on the forward side.

(b) In the event of theft, loss or mutilation of the registration or license sticker provided for in this article, the person owning such bicycle shall make application to the Police Department. Upon proper identification of the owner and bicycle and upon the payment to the Police Department of a fee of $0.50, a new registration certificate or license number sticker or both shall be issued.

Sec. 40-292. - Same—Renewal generally

Bicycle licenses shall be renewed uniformly throughout the City, at periods not to exceed five years, to be designated by the director of the department of motor vehicles. Renewal of a bicycle license shall be indicated by a supplementary adhesive device affixed on or near the license.

Sec. 40-293. - Same—Term.

The registration of bicycles as provided in this article shall begin with January 1, 1975, and such license and registration shall be subject to renewal at periods not to exceed five years.

Sec. 40-294. - Same—Upon sale or transfer.

(a) Any person residing within the City who sells or transfers ownership of any bicycle, shall, within ten days of the date of such sale or transfer, report such sale or transfer by returning to the Police Department the registration certificate issued to such person as licensee thereof, together with the name and address of the person to whom such bicycle was sold or transferred.

(b) Any person who purchases or otherwise acquires possession of a bicycle shall within ten days of taking possession apply for the transfer of license to his name.

(c) Any person engaged in the business of selling new or used bicycles shall make a weekly report to the Police Department, giving a list of all sales made by such person, which list shall include the name and address of each person to whom sold, the make and kind of the bicycle sold, together with a description and serial number thereof and the number of the license attached thereto, if any.

(d) Any person engaged in the business of buying used bicycles shall make a weekly report to the Police Department, giving the name and address of the person from whom each bicycle is purchased, a description of each bicycle purchased, the serial number thereof and the number of the license number sticker found thereon, if any.
