Sec. 30-1. - Parks and recreational areas; conduct in.¶
(a) One of the principal goals of the City is to provide maximum open space and recreational facilities. This chapter is adopted to ensure that the residents of the City will be able to enjoy the full benefits thereof in peace and safety.
(b) The Community Services Director shall prepare regulations for conduct in public parks and recreational areas within the City, which regulations shall be subject to approval of the City Council.
(c) Any person dissatisfied with any decision of the Community Services Director relating to conduct in public parks and recreational areas may appeal that decision to the City Council by filing written notice of appeal with the City Clerk within ten days of first learning of such decision. The City Council shall consider any such appeal at its next regular meeting after the filing of the notice of appeal. The determination of the City Council shall be final.
(d) The possession or consumption of alcoholic beverages is prohibited in any public park, public building, or public recreational facility in the City except as may be expressly authorized by a permit issued by the City Manager. The fees for such permit and appropriate standards by which the permit shall be issued shall be established from time to time by resolution of the City Council.
(e) It is unlawful to ride a skateboard within or about the Central Park Facilities, including the Community Center.
(f) It is unlawful to ride roller or blade skates within or about the amphitheater facility located within Central Park.

Sec. 30-2. - Park curfew.¶
(a) It is unlawful to enter, remain, or loiter, including using or parking a vehicle, in or upon the grounds of any City park between the hours of 10:30 p.m. and 5:00 a.m. of the following day. This section shall not apply to persons authorized to be in or upon the grounds pursuant to City sponsored or other lawfully authorized activity.
(b) Every person who violates this section is guilty of an infraction and shall be subject to a fine not to exceed $50.00 for the first violation, $100.00 for the second violation within the same year and $250.00 for every subsequent violation within the same year.

Sec. 30-3. - Civic Center facilities; conduct in.¶
It is unlawful to ride a skateboard or roller or blade skates within or about the Civic Center Facility.

Sec. 30-4. - Smoking prohibited in public parks and city facilities and immediately…¶
(a) Smoking of any kind as defined in this section is prohibited and unlawful in any public park or City facility and within 25 feet of any public park or City facility, including, but not limited to, public sidewalks, streets, and alleys, except for smoking in a private vehicle that is in motion on a public street or alley, unless smoking in the private vehicle is otherwise prohibited by state law. A vehicle is in motion if it is moving or if it is stopped at a stop sign or red light. It is prohibited and unlawful to dispose of any part of lighted or unlighted cigars or cigarettes or cigarette butts, electronic cigarettes of any kind as defined in this section, or any other tobacco-related waste, in or within 25 feet of any portion of any public park or City facility, including parking lots contained within, except in areas designated for smoking by City Council resolution, and indicated by visible signage as smoking areas. Nothing in this section is intended to or shall be construed to preempt or otherwise limit the provisions of California Health and Safety Code Section § 104495 relating to smoking near playgrounds and tot lot sandbox areas.
(b) No person shall dispose of any part of a cigarette, electronic cigarette, or cigar or tobacco of any kind, except in a designated waste disposal container.
(c) The following words, terms and phrases when used in this section shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:
Smoke or smoking means the inhaling, exhaling, carrying, possessing or holding of a lighted pipe, cigar, cigarette, or any other lighted smoking product or equipment used to burn any tobacco products, weed, plant, or any other combustible substance; using or operating an electronic cigarette of any kind that may or may not include nicotine; and using chew tobacco or tobacco of any kind.
Electronic cigarette, also known as an e-cigarette, means a device intended to emulate smoking, which can be used to deliver an inhalable dose of nicotine or any other substance through a vaporized solution. Electronic cigarette includes any such electronic or battery-powered device, whether manufactured, distributed, marketed or sold as an electronic cigarette, e-cigarette, an electronic vaping device, a personal vaporizer, an electronic nicotine delivery system ("ENDS"), an electronic cigar, an electronic cigarillo, an electronic pipe or any other product name or descriptor. Electronic cigarette shall include any refill, cartridge and any other component of an electronic cigarette.

Sec. 30-5. - Penalty.¶
Any person who violates any provision of this chapter shall be deemed guilty of an infraction and upon conviction thereof shall subject to the general penalties described in Section 2-351 (Infraction Penalty).
