Kern County Municipal Code Ch. 9.32 Ice Cream Trucks

The following words, as used in this chapter, shall have the signification attached to them in this section, unless otherwise clearly apparent from the context:

A. "Dispense" or "dispensing" means selling, peddling, hawking, displaying for sale, soliciting the sale of, offering or exposing for sale or giving away.

B. "Food" means frozen refrigerated desserts, confections or novelties commonly known as ice cream, prepackaged candies, prepackaged snack foods or soft drinks.

C. "Ice cream truck" means a motor vehicle engaged in the curbside vending or sale of food.

D. "School" means any elementary school, middle school, junior high school, high school, senior school or continuation school, or any branch thereof.

E. "Street" means all that area dedicated to public use for public street purposes and shall include, but not be limited to, roadways, parkways, alleys and sidewalks.

No person shall dispense any item, other than food, from an ice cream truck on a street.

No person shall dispense any item, including food, from an ice cream truck on a street in any area of the county which is zoned for residential use, after sunset and before nine a.m. of the following day.

No person shall dispense any item, including food, from an ice cream truck, Monday through Friday, within one hundred fifty (150) feet of any school in the county.

No person shall permit a person under sixteen (16) years of age to ride in or on an ice cream truck unless the person in control of the ice cream truck is the parent or guardian of the minor.

Any person operating an ice cream truck shall at all times comply with other applicable sections of this Code and applicable sections of the California Vehicle Code.

Any person who violates any provision of this chapter is guilty of a misdemeanor. Violations set forth in this chapter are cumulative to, and in addition to, any other violations of state law.
